Research from the National Wills Report 2025 found that 29% of people with a Will haven’t told anyone where to find it.

❌ MYTH: If you’ve lived with your partner for many years, you’re effectively married in the eyes of the law.
✅ FACT: There is no such thing as a “common-law marriage” in England and Wales. Living together does not give you the same legal status or rights as being married or in a civil partnership, even if you have lived together for a long time or have children.

This can be particularly important when it comes to property, finances and what happens if one partner dies.

The law in this area may change in the future. The Ministry of Justice’s public consultation, A Fairer End to Relationships, which included proposals to strengthen protections for cohabiting couples, closed on 14 August 2026. However, no changes have been made to the law as a result of the consultation at this stage, and there is no guarantee that the proposals will become law or when any changes might come into force.
