๐Ÿก๐Ÿ” Buying a House? What Are Searches Actually Searching For?

You've found the house. Your offer has been accepted. You've instructed your solicitor...

And then someone tells you they're waiting for the searches.

But what are they actually searching for?

Property searches help your conveyancer uncover important information about the property and surrounding area that you might not discover simply by viewing the house.

Depending on the property and location, searches can provide information relating to things such as:

๐Ÿ—๏ธ Planning & Building Regulations โ€“ including relevant planning decisions and building control information.

๐Ÿ›ฃ๏ธ Roads & Access โ€“ including whether adjoining roads are publicly maintained and certain proposals that could affect the property.

๐Ÿ’ง Water & Drainage โ€“ including connections to mains water and sewerage and the location of certain public pipes.

๐ŸŒณ Environmental Matters โ€“ which may identify issues such as contaminated land and other environmental risks.

๐ŸŒŠ Flood Risk โ€“ additional searches may be recommended where flooding could be a concern.

โ›๏ธ Mining & Ground Stability โ€“ particularly relevant in former mining areas such as parts of South Yorkshire.

Your conveyancer will consider which searches are appropriate for the property you're buying and explain anything that needs further investigation.

Because buying a home isn't only about what you can see at the viewing, it's also about understanding what you're actually buying.

Our experienced Conveyancing Team can guide you through the process from offer to completion.

๐Ÿ’š World Mental Health Day | Behind Every Legal Matter Is a Person

Legal problems rarely arrive neatly packaged as simply a 'legal problem'.

A relationship ending. Worries about your children. The death of someone you love. Being arrested or facing court proceedings. Moving home. A dispute that has become overwhelming.

Behind every file is a real person who may be experiencing uncertainty, worry or one of the biggest changes in their life.

This World Mental Health Day, we're reminding ourselves of something that's important every day at Norrie Waite & Slater - the person behind the paperwork matters.

We may not be able to remove every worry, but good legal advice can help provide clarity, understanding and a way forward when circumstances feel difficult or uncertain.

And sometimes, asking for help is the most important first step you can take.

If you're struggling with your mental health, you don't have to manage that alone either. Organisations including Mind, Samaritans and NHS mental health services provide information and support.

๐Ÿ’š Take care of yourself. Check in with someone you care about. And remember that it's always OK to ask for help.

โš–๏ธ Legal Word of the Week: Mitigation

You've probably heard the phrase "mitigating circumstances" in the news, on television or in relation to a court case - but what does mitigation actually mean in law?

In criminal proceedings, mitigation is information put before the court after someone has pleaded guilty or been convicted, which can help the court understand the individual circumstances of the offence and the person involved before deciding on an appropriate sentence.

Mitigation might include factors such as:

โš–๏ธ Personal circumstances
โš–๏ธ Previous good character
โš–๏ธ Remorse and acceptance of responsibility
โš–๏ธ Steps taken since the offence
โš–๏ธ Relevant circumstances surrounding what happened

Mitigation doesn't excuse an offence or mean that there won't be consequences. Instead, it helps ensure the court has relevant information when considering sentence.

At Norrie Waite & Slater, our experienced Criminal Defence Team provides advice and representation throughout the criminal justice process - from initial police station interviews through to representation at the Magistrates' and Crown Courts.

If you're facing a criminal investigation or court proceedings, getting legal advice as early as possible can help you understand what happens next and the options available to you.

๐Ÿก We're Separating โ€“ What Happens to the House?

When a relationship comes to an end, one of the biggest questions can be:

"What happens to our home?"

For many couples, it's not only their largest financial asset โ€“ it's also the place where they've built a life together and, where children are involved, their family home.

There isn't one answer that applies to everyone.

Depending on your individual circumstances, questions might include:

๐Ÿก Can one of us stay in the property?
๐Ÿ’ท Who pays the mortgage while we sort things out?
๐Ÿ”‘ Can one person buy the other person's share?
๐Ÿ  Will the house need to be sold?
๐Ÿ‘จโ€๐Ÿ‘ฉโ€๐Ÿ‘ง What happens if children are living at the property?
๐Ÿ’ Does it make a difference if we're married or unmarried?
๐Ÿ“„ What if the property is only in one person's name?

The legal position can be different depending on whether you're married, in a civil partnership or cohabiting, as well as how the property is owned and your wider financial circumstances.

That's why it's important not to make assumptions about what you're entitled to โ€“ or agree to something significant โ€“ without first understanding your legal position.

At Norrie Waite & Slater, our experienced Family Law Team can help you understand your options and work towards the right way forward for your individual circumstances.

If you're separating and don't know where to begin, a conversation with our team can help make things a little clearer.

โšฝ New Football Season Underway.. Know Where You Stand.

With the new football season now well underway, thousands of supporters are once again heading to matches across the country.

For the vast majority, matchday is simply about supporting their team. However, if you are arrested or facing criminal allegations in connection with a football match, the consequences can extend beyond the offence itself and may include a Football Banning Order.

What is a Football Banning Order?

Football Banning Orders are designed to prevent football-related violence and disorder and can be imposed by the courts in connection with certain football-related offences.

An order can have a significant impact on someone who regularly attends matches, potentially preventing them from watching their club both at home and, in some circumstances, abroad.

What could a Football Banning Order involve?

Depending on the circumstances, restrictions can include:

โšฝ Being prohibited from attending regulated football matches in the UK for a number of years
๐ŸŸ๏ธ Exclusion from specified areas around football grounds on matchdays
โœˆ๏ธ Requirements relating to international fixtures and tournaments, which can include surrendering your passport at specified times
๐Ÿ“‹ Other conditions considered necessary by the court

Breaching a Football Banning Order is itself a criminal offence, so understanding exactly what an order means is extremely important.

Arrested or asked to attend an interview?

You don't have to go through it alone.

Norrie Waite & Slater's Police Station Team is available 24 hours a day, 365 days a year.

If you are interviewed under caution at a police station, you are entitled to free and independent legal advice. You can ask the police to contact Norrie Waite & Slater on your behalf and our team can provide advice and representation.

If you've already been arrested and are waiting to hear what happens next, or you're facing charges relating to a football match, contact our experienced Criminal Defence Team for advice about your individual circumstances and the next steps available to you.

โšฝ No matter who you support, Norrie Waite & Slater are here to support you.
