LEGAL UPDATE - The Children’s Wellbeing and Schools Act 2026
The Children's Wellbeing and Schools Act 2026 received Royal Assent on 29 April and is now law. Government says that the Act will 'make important changes to protect children and improve education with work beginning from now to put these changes into place. The Act focuses on making sure no child falls through gaps between different services and that families can get help when they need it. It also makes the changes needed to ensure every child can get a great education at a good school in their area'.
Many SEND parents have contacted me, concerned by the Act's changes to home education; the most concerning measure being a new requirement for local authorities to keep a register of children educated at home and local authorities having the power to intervene where home education is deemed unsuitable for a child. What will be deemed as a “suitable home education” is yet to be established.
I want to reassure parents and carers that while the Act is now law, nothing immediately changes. The Act will be rolled out in phases, with further guidance, consultation, and training before the Act takes effect.
As with any major reform, legal challenges are expected, and further clarification will follow. For now, I want families to be reassured that implementation of the Act will be gradual and I will provide further updates as and when they occur.
