I had this exact conversation with someone yesterday! House in one person's name and not married...... Thankfully I have had an opportunity to make them aware of the implications for the survivor.

Have you written a will… but is it safe?

We receive emails every day from people and companies trying to locate the will of a deceased person, often contacting multiple firms in the hope of finding it.

Writing a will is essential but keeping it safe and easy to find is just as important. If a will can’t be located, it could mean your estate is distributed very differently from what you intended.

For a small annual fee, we offer our clients a secure storage service, giving peace of mind now and in the future. We also register the will’s location on the National Will Register, a vital resource for Executors when it matters most.

When it comes to an English Will, how it’s signed and witnessed is just as important as what it says.

Under English law, a Will must be signed by the person making it in the presence of two witnesses at the same time, and those witnesses must also sign the will. The witnesses must be over 18 and cannot be beneficiaries (or married to beneficiaries) — otherwise gifts in the Will could fail.

If these formalities aren’t followed exactly, the Will may be deemed invalid, no matter how clear your intentions were. That can lead to delays, disputes, and your estate being distributed under intestacy rules instead of your wishes.

Getting the signing and witnessing right helps ensure:

✔️ Your will is legally valid
✔️ Your wishes are carried out as intended
✔️ Your loved ones are spared unnecessary stress and uncertainty

A Will isn’t just a document — it’s a legal process. Taking care with the final signing makes all the difference.

Young Onset Dementia: Planning While You Can Matters

Dementia doesn’t only affect older people. Young onset dementia can impact individuals and families while careers, children, and busy lives are still in full swing.

One of the most important steps you can take early is putting Lasting Powers of Attorney (LPA) in place. LPAs allow you to choose who will make decisions about your finances, health, and care if there comes a time you can’t make them yourself.

Without an LPA, families may face delays, stress, and difficult legal processes at an already overwhelming time.

Planning ahead isn’t about giving up control — it’s about protecting your wishes and supporting the people you love.

If you are keen to put your plans in place then get in touch.

It’s encouraging to see more people creating their wills at a younger age.

When applying for a mortgage, you’re often asked: Do you have a Will?

Financial advisers also actively encourage clients to review their wills as part of sound financial planning.

There’s little point in saving and planning for the future if your wishes aren’t clearly documented.

In a country where we have the right to decide who inherits our wealth, not having a will means giving up that choice.

Leaving things to chance could result in your hard-earned assets passing to family members you’ve never met.

Having a will isn’t just paperwork — it’s peace of mind.

Please get in touch for a free, no obligation initial discussion if you are keen to put your plans in place.
