ā€¼ļø On 1st July a new Sentencing Guideline for Assaults, including on Emergency Workers, came into forceā€¼ļø

For the first time, judges and magistrates in England and Wales will have specific guidance for sentencing offences of assault on emergency workers, which reflects legislation that increased the maximum sentence for common assault when the victim is an emergency worker.

Other changes include:

āš–A new high-culpability factor of ā€œintention to cause fear of serious harm, including disease transmissionā€ in the common assault guideline
āš–A new aggravating factor of ā€œdeliberate spitting or coughingā€ in the common assault and assault causing Actual Bodily Harm (ABH) offences guidelines
āš–A new high-culpability factor of strangulation to include asphyxiation and suffocation in all guidelines except attempted murder
āš–A revised high-culpability factor of ā€œvictim obviously vulnerable due to age, personal characteristics or circumstancesā€ across all guidelines
