📢 Landlords, Don’t Risk It—Protect That Deposit! 🏡💰
If you're letting a residential property in England or Wales, taking a deposit is common practice—but not protecting it properly can cost you.

✅ What you need to know:
Since 6 April 2007, any tenancy deposit you take must be placed in a government-backed protection scheme within 30 days. These include:

• Deposit Protection Service (DPS)
• MyDeposits
• Tenancy Deposit Scheme (TDS)

These schemes keep the deposit safe and ensure it’s returned to the right person at the end of the tenancy.

📩 You also need to give your tenant the ‘prescribed information’, including:

• The scheme’s name & contact info
• How much was paid
• The property address
• Your contact details
• How the deposit will be returned
• What happens if there’s a dispute

⛔ What happens if you don’t?
If you miss the deadline or skip deposit protection altogether, you could face serious consequences.

A court can order you to pay your tenant up to 3x the deposit amount for every breach. (Each new tenancy issued, or each time a tenancy goes ‘periodic’, without a protected deposit can count as a ‘breach’!)

Landlords: Are Your Legal Certificates in Place? 🏠⚖️

In England & Wales, landlords must hold valid safety certificates for their properties. This includes:

✅ Gas Safety Certificate (Gas Safety Regulations 1998)
✅ Energy Performance Certificate (EPC)
✅ Electrical Installation Condition Report (EICR)

❗ Without these, landlords risk heavy fines — and complications if you ever need to regain possession of the property.

But what if your tenant is blocking access for inspections or repairs?
It’s a common issue — and one we’ve handled many times. The answer: apply for an injunction.

🔹 What is an injunction for the purpose of gaining access?

It’s a court order which warns one of the parties involved what the consequences of continued denial of access.


🔹 What if they still refuse?

Further court action can allow for enforced access — and penalties against the tenant.
