If a case is registered against you, in order to get bail, first read the provisions of the FIR carefully and see whether the provisions imposed are bailable or non-bailable.

If the provisions are bailable then it will not be difficult to get bail and if they are not bailable then the following things should be carefully observed:

First check whether the provisions that have been written apply to the story of the FIR or whether the non-bailable offenses have been wrongly registered.

At the same time, having or not having a criminal record of your past is also somewhat helpful.

One thing to keep in mind is that if a crime is punishable by imprisonment or a fine, it will be considered bailable, no matter how serious the crime.

اگرآپ پر مقدمہ درج ہوجائے تو اسکی ضمانت کروانے کےلیے سب سے پہلے ایف آئی آر میں لگائے گئے دفعات کو بغور پڑھا جائے اور دیکھا جائے کہ آیا لگائے گئے دفعات قابل ضمانت ہیں یا ناقابل ضمانت-

پھراگر دفعات قابل ضمانت ہوں تو ضمانت کرانے میں مشکل در پیش نہ ہوگی اور اگر ناقابل ضمانت ہوں تو مندرجہ ذیل چیزوں کا بغور مشاہدہ کیا جائے:

سب سے پہلے یہ دیکھیں کہ آیا جو دفعات لکھی گئی ہیں کیا وہی دفعات ایف آئی آر کی کہانی کے مطابق لاگو ہوتی ہیں یا غلط طور پر ناقابل ضمانت جرائم کا اندراج کیا گیا ہے-

اسکے ساتھ ساتھ آپکے ماضی کا کریمینل ریکارڈ کا ہونا یا نہ ہونا بھی کسی حد تک مدد گار ثابت ہوتا ہے۔

ایک بات یاد رکھیں کہ اگر کسی جرم کی سزا قید یا جرمانہ ہو تو وہ قابل ضمانت تصور ہوگا چاہے جرم کتنا ہی سنگین کیوں نہ ہو۔

Universal Declaration of Human Rights

Article 29:
(1) Everyone has duties to the community in which alone the free and full develop- ment of his personality is possible.
(2) In the exercise of his rights and free- doms, everyone shall be subject only to such limitations as are determined by law solely for the purpose of securing due recognition and respect for the rights and freedoms of others and of meeting the just requirements of moral- ity, public order and the general welfare in a democratic society.
(3) These rights and freedoms may in no case be exercised contrary to the purposes and principles of the United Nations.
