Not all properties are subject to restrictive covenants, but they're commonly found on new builds, housing estates, ex-local authority homes, older properties, and multi-dwelling residential developments.

These legal restrictions can limit what you can do with your property, from building extensions to running a business from home.

Restrictive covenants are typically found in title deeds and can apply to both freehold and leasehold properties.

They're particularly common where a plot of land has been sold whilst the seller retains the remaining land, or on estates where developers want to maintain certain standards.

Instead, they'll need to apply to the Court of Protection for a Deputyship Order. This process can take months and cost thousands of pounds.

This is one of the most common misconceptions in estate planning.

Despite what many people believe, "next of kin" has no legal basis in English law.

If you die without a Will, your estate is distributed according to the Intestacy Rules, a strict hierarchy that determines who inherits and in what order.

This can lead to unintended consequences. Your partner may not inherit if you're not married, certain family members could be excluded, and your estate might not be distributed as you would have wished. The only way to ensure your assets go to the people you choose is by making a Will.
