“Will their Godparents automatically assume care of our child if both me & my partner die?”

In short: No.

While godparents often play an important spiritual or moral role, they have no legal authority to assume care for their godchild following the death of their parents (you and your partner).

Only a legally appointed guardian—named in a valid Will—has the legal right to assume parental responsibility in such a situation.

⚠️ If no guardian has been appointed, the court may need to step in to decide who will care for your child. During this time, it’s possible that your child could be placed in temporary care — potentially for weeks or even months — until a guardian is officially chosen by the court. And that guardian may not be someone you would have selected yourself. ⚠️

Although the court will always act in your child’s best interest, this process can add unnecessary distress at an already traumatic time.

Most people appoint one to four attorneys, but in England and Wales, there’s no legal limit on how many you can appoint in your Lasting Power of Attorney (LPA).

You can have one or more attorneys - and if you choose more than one, you decide how they’ll make decisions:

All attorneys must agree on every decision.

🤝👍 Jointly and Severally:
Attorneys can act together or independently.
