Sideways disinheritance: the risk most families don't see coming

Picture this: one partner passes away, leaving everything to the other. Years later, the surviving spouse remarries and when they're gone, the home ends up with the new spouse's family rather than the children of the first marriage.

This is known as sideways disinheritance, and it can mean everything you've worked for ends up outside your bloodline.

A Property Protection Trust prevents it by ring-fencing your share of the family home for your children, while still allowing your surviving spouse to live there for as long as they need. A simple step that protects the people who matter most.

Estate planning is our specialism

When it comes to your Will, LPA or estate planning, who you choose to handle it really matters.

Here's what makes us different to a high-street solicitor:
• Focused expertise: Later life planning is all we do, not one of many services
• Personal and remote: Work with your own dedicated consultant from the comfort of home – no office visits needed
• Fixed, affordable fees: Clear pricing from the start and no surprise bills
• Trusted credentials: Your documents are prepared by a member of the Society of Will Writers, so you know you're in safe hands

It's expert, legally sound advice with a personal touch and at a price that works for you.

Who should you choose as the executor of your will?

Your executor is the person who'll carry out the wishes in your Will, so it's worth giving the choice some real thought.

What an executor actually does:
• Applies for probate and handles the paperwork
• Pays any debts, bills and inheritance tax
• Distributes your estate to the right people
• Keeps clear records and acts fairly throughout

It's a role that can take months, so look for someone who is:
• Organised and comfortable with paperwork
• Trustworthy and able to stay impartial
• Available - not too busy with their own commitments
• Willing to take it on (always ask them first)

You can name up to four executors. Many people choose two who'll work well together or appoint a professional for extra peace of mind.

Setting up a Lasting Power of Attorney

Making arrangements for a Lasting Power of Attorney doesn’t have to feel complicated – it’s simply about making sure the right people can support you if needed.

Here’s what to consider for your LPA:
• Who to appoint: Choose someone trustworthy, organised, and able to act calmly
• How many attorneys: There’s no limit to how many attorneys you can choose – most people choose between one and four
o If you appoint more than one, you’ll have to specify whether they must all be in agreement or can act independently
• Instructions and preferences: You can include guidance for your attorneys
• Replacement attorneys: In case your first choice can’t act for you
• Timing: LPAs can take 8-10 weeks to register, so planning ahead is essential

It’s fairly straightforward to set up an LPA; just contact us and we’ll guide you through the process in a relaxed, jargon-free way, all from the comfort of your own home.

Creating an LPA is an important step towards peace of mind - a little preparation goes a long way. Before your appointment, consider:
• Who you trust: Decide who you want to act as your attorney for health, welfare, or finances
• What powers they’ll need: Think about whether it’s just finances, just health decisions, or both
• Backup choices: It’s wise to choose replacements in case your first choice can’t act
• Special instructions: Any specific wishes you want your attorney to follow

Our experienced team will guide you through the rest, making the process simple and stress-free. Call us on 0333 050 8141 or get a free quote at www.evertrustestateplanning.co.uk/contact-us
