Happy New Year. I hope you enjoyed the festive season and ready to take on what's in store for 2026. If the last couple of weeks have been difficult for you, I send my best wishes.

Legal Rights - what are they are who can claim? Legal rights are only available in Scottish Estates when a parent or grandparent passes away. In Scotland you cannot disinherit any child or children on your moveable estate, which are liquid assets. Your home is excluded. Even if someone dies leaving a Will, you can still claim your legal rights. Not a lot of people are aware of legal rights. If you have lost a parent and even if their estates have been finalised, you can still make a claim. If you have lost a grandparent and you are a child of a deceased parent, you can also claim as a representative of your mother/father. The importance of making a Will is often overlooked - many people believing they don't have any or enough assets. However, if you own your own home (even with a mortgage) it is extremely important to have a Will done. This ensures that your estates goes to your selected beneficiaries and your estate does not fall into intestacy.
