Need the keys back to your property?

If you are a landlord, managing agent or property manager and you need the property to be handed back to you, the most straight forward way is a Section 21 notice. Whilst these will be disappearing at some point next year, they are still valid and in use. However time is running short so no room for error!

"The fixed term is coming to an end on my property? should I ask the tenant to enter a new one?"

This is a common question we get at Landlord Support. When a residential tenancy comes to an end of its fixed term, it will roll on as a periodic tenancy. There are benefits and disadvantages of renewing a fixed term. Benefits include the ability to renegotiate terms such as duration of stay and rent value, but there are disadvantages too. These include re-serving of documentation and the additional admin, potentially re-protecting a deposit but also losing the ability to serve a notice for an extended period of time to regain possession of the property.

The tenant has left, but not taken all their property!!

It’s not uncommon for landlords to be left with property of the former tenant that has not been taken with them, either by mistake or on purpose. This area is governed by the Torts (Interference with Goods) Act 1977. It is important you don’t expose yourself to risk by mishandling these items.

Don’t just get rid!! If you have the tenant’s property then under the Torts Act, you have specific responsibilities to fulfil.

But it has cost me, the landlord, money! - There is a strictly defined list of what a landlord can charge a tenant set out in the Tenant Fees Act 2019.

The following are charges a landlord can put on the tenant to recover costs they have incurred during their stay:

• rent
• bills for utilities, phone, broadband and TV
• a tenancy deposit
• a holding deposit
• replacing the keys
• paying the rent 14 days late or more
• changing the tenancy (only if the tenant asked for the change)
• ending the tenancy early
• council tax
• a TV licence
• the cost of repairs if the tenant damages the property

What am I responsible for? Many tenancy agreements set out claims of what the tenant is liable for and must remedy or repair. But did you know this is specified in law? Specifically private landlords are responsible for:

• electrical wiring
• gas pipes and boilers
• heating and hot water
• ventilation and chimneys
• sinks, baths and toilets
• plumbing and drains
• internal and external walls
• stairs and bannisters
• doors and windows
• the roof

A landlord is always responsible for these repairs, which are legally implied by section 11 of the Landlord and Tenant Act 1985.

Purchasing a property with tenants in situ? Or taking on the property management from A.N.OTHER?

The landlord of property must provide an address in England and Wales at which the tenant can serve notices on the landlord. If the landlord does not comply with this requirement the rent, or service charge, is to be treated as not due.
In addition, where there has been a change in landlord, the new landlord must give notice of the assignment to the tenant either:

• within two months after the transfer of interest in the property
• no later than the next day that rent is payable, where this is more than two months after the transfer
