USCIS fees are going up. Twice before the end of the year.
Here's what's changing, when, and who it affects.
16 OCTOBER 2026: ANNUAL INFLATION ADJUSTMENT
H.R. 1 immigration fee provisions enacted in 2025 require USCIS to adjust certain fees for inflation every fiscal year. This round reflects a 3.36% rise in consumer prices between July 2025 and July 2026.
- Immigration parole fee (I-131): $1,020 to $1,050
- Initial EAD for asylum applicants, parolees and TPS applicants (I-765): $560 to $570
- TPS application (I-821): $510 to $520
- Annual asylum fee: $102 to $105
Unchanged: the $100 initial asylum fee, the $250 SIJ fee and the $275 asylum EAD renewal. OPT, STEM OPT and green card filing fees are outside this adjustment.
On the annual asylum fee: it applies to certain asylum applications that stay pending past the required period. A federal court order currently limits the consequences of missing the payment deadline while litigation continues.
30 NOVEMBER 2026: NEW EB-5 FEES
A separate final rule more than doubles the main EB-5 petition fees.
- I-526 (standalone investor): $3,675 to $7,615
- I-526E (regional center investor): $3,675 to $7,850
- I-829 (removal of conditions): $3,750 to $5,000
The I-526 and I-526E totals above include a new $75 technology fee. Each I-526E filing also carries a $1,100 EB-5 Integrity Fund fee. The rule creates Form I-527 for certain pre-2022 investors, at $10,330. Minimum investment amounts stay the same.
THE POSTMARK DECIDES
USCIS goes by postmark date. Send the old fee on or after the deadline and the filing is rejected. A few dollars short is enough. Rejected filings have to be resubmitted, and that costs time.
If your application is ready, filing before the deadline keeps you on the current fee. Either way, check the USCIS fee schedule (Form G-1055) for your exact form and category before you pay.
Not sure which fee applies to you? Comment FEES or send us a DM and our US immigration team will get back to you.
