International Institute for the Unification of Private Law - UNIDROIT has launched a consultation on its 𝗗𝗿𝗮𝗳𝘁 𝗟𝗲𝗴𝗶𝘀𝗹𝗮𝘁𝗶𝘃𝗲 𝗚𝘂𝗶𝗱𝗲 𝗼𝗻 𝗕𝗮𝗻𝗸 𝗟𝗶𝗾𝘂𝗶𝗱𝗮𝘁𝗶𝗼𝗻 and, due to their expertise in this area, INSOL Europe members have been invited by the Secretary-General of UNIDROIT, Prof Ignacio Tirado, to provide feedback.

The INSOL Europe Academic Forum meets in Amsterdam in just about 6 weeks time. We are running on the theme of 'The Perpetual Renewal of European Insolvency Law' and look forward to welcoming lots of fascinating ideas on this topic. Our first panel looks at the 'Ever-Evolving Landscape of Preventive Restructuring.' Here is a glimpse into what you can look forward to:

Since 2016 the big restructuring discussions have centred around the Preventive Restructuring Directive 2019/1023, whether that has been how it should be drafted or changed prior to entering into force when it was a mere proposal, prognostication around the issues that may arise in relation to specific provisions that may be in conflict with local rules in the run up to implementation, to the delays and struggle and experiences in implementing the directive over the last few years. The discussion continues during our first panel session where we revisit the absolute priority rule specifically as it affects restructuring in Slovenia (Jaka Cepec), an issue that has attracted controversy since the beginning. The effectiveness of debt discharge under EU law is also an important discussion during these difficult economic times (Remigijus Jokubauskas). Finally, as a harmonizing directive, how has it functioned to encourage convergence? Sjur Swensen Ellingsæter examines this issue, specifically in relation to the choice of priority rules in the implementation of the Preventive Restructuring Directive.

Dennis Cardinaels writes the second chapter (pgs 23-37) of the newest INSOL Europe Academic Forum Technical Series Publication: "Insolvency Law: Back to the Future" first presented at the conference in Dublin in March 2022. Dr Aleksandra Krawczyk, MSc, LL.M of ECO LEGAL Law Firm and Uniwersytet Opolski asks whether Poland has forgotten to list its special COVID-19-related Restructuring Proceedings in Annex A of the EIR? Aleksandra will try to give an answer to this question, as well as examine what consequences the lack of such listing may have in (court) practice during the first panel of INSOL Europe Academic Forum's second day in Dubrovnik.

The second day of the INSOL Europe Academic Forum (6 October) begins with a panel that focuses on National Reports on Insolvency and Restructuring Law. Andrea Zorzi of the Università degli studi di Firenze opens this panel with a presentation on the situation in Italy.

Andrea summarises: Italian insolvency law reform is finally done after a lengthy process and many stops-and-gos. New rules for judicial composition with creditors, new rules for approval, and reasonable national implementation of the Relative Priority Rule envisaged by the Directive. New rules have also been introduced for the involvement of shareholders.

When we last met in October 2019 in Copenhagen, we told each other ‘Arrivederci a Napoli, in September 2020.’ Little did we know that our plans would be cancelled because the COVID-19 pandemic which took over the world at the beginning of 2020. Unfortunately, the pandemic led us to cancel not one, but two, academic conferences.

To give our members the opportunity to meet in person before our “traditional” autumn conference, INSOL Europe organised an extraordinary conference in March 2022 in Dublin, Ireland. Located at the north-western edge of Europe, with its rich past and one of the most modern, developed service and financial sectors in Europe, Dublin was a fitting location for our first in-person conference following COVID-19. Despite the traumatic news of the events occurring on the border between Ukraine and the Russian Federation, INSOL Europe’s Annual and Academic Forum conferences were invaluable opportunities to discuss insolvency and restructuring reforms, challenges, and opportunities across Europe.

While the global impact of COVID-19 in the area of insolvency and restructuring was noted, the papers presented at the Academic Forum focused primarily on long-term issues, reflecting the variety of interests and expertise of the INSOL Europe members. The panels covered a range of topics and subjects, including cross-border insolvencies, the need to protect special categories of creditors and debtors, the challenges presented by crypto-assets and the 4th industrial revolution, and issues in consumer bankruptcy. We hope you will find the new publication an interesting and useful read.
