Many will have seen the moving interview on ITV News featuring Eva Hender and Tom Hender, who shared the heartbreaking story of their son Aubrey, stillborn just before 37 weeks.

Their experience highlights a significant gap in UK law.

Currently, stillborn babies are not entitled to a coroner led inquest. This means families can be denied an independent investigation into the circumstances surrounding their baby’s death even where there are serious concerns about care or possible medical failings.

An inquest is not about blame. It is about answers, transparency, and learning. For many families, it provides clarity and reassurance that lessons can be learned to help prevent similar tragedies.

As it stands, even proposed changes under the UK Maternity Review may only apply to babies born after 37 weeks leaving many families, including the Henders, without access to this vital process.
