It is one of the most common questions our Family Law team is asked, and the honest answer is: it depends.

When a couple separates, the family home is usually one of the most significant assets to consider. The court looks at a range of factors including the financial position of both parties, the needs of any children, and what is fair in the circumstances.

There are several possible outcomes:

If your employer has asked you to sign a Settlement Agreement, the first thing to know is this: you do not have to figure it out alone.

Settlement Agreements are legally binding documents that typically bring your employment to an end in exchange for a financial payment. Before the agreement becomes valid, you are legally required to take independent legal advice - and in most cases, your employer will cover the cost of that advice.

So what should you be checking before you sign?

- Is the financial offer fair given your circumstances?
- Are any restrictive covenants reasonable?
- Are your references and exit arrangements clear?
- Have all outstanding pay, bonuses, or benefits been included?
