A Will is the only sure-fire way of ensuring your assets are distributed in the way you wish, if you were to pass intestate (without a will) the government dictates how your assets are distributed.

A will is the only way of assigning guardianship of children under 18 without involving the judicial system.

If you were to lose capacity without a Lasting Power of Attorney (LPA) in place, you wouldn’t be able to renegotiate your mortgage or any other financial commitments either, meaning you wouldn’t be able to secure the best deal for your circumstances in the future and you could end up on the standard variable rate for the remaining term of your mortgage.

You couldn’t sell the property either as you wouldn’t have the capacity to sign the required documentation.
