When the Legal Aid, Sentencing and Punishment of Offenders Act 2012 (LASPO) was introduced, most legal aid for private family law was removed (e.g., divorce, child contact and residence) unless there was evidence of domestic violence, child abuse, or child abduction.

One thing that genuinely frustrates me in family court is how often important parts of orders are left “to be agreed between the parties”.

But… they can’t agree.

That’s usually why they’re at court in the first place.

I completely understand why courts encourage flexibility and cooperation between parents. In the right cases, that’s absolutely the correct approach. But vague wording often creates more conflict, not less.

Things like:
• holiday arrangements
• handover times
• video calls
• collection locations
• passports and foreign travel
• missed contact
• indirect contact

…are sometimes left hanging without proper clarity.

Then weeks later:
“I thought we agreed this.”
“No, that’s not what I meant.”

And suddenly everyone is arguing again.

A good court order should not just solve today’s dispute. It should help prevent the next one.

If something feels unclear during a hearing, don’t be afraid to politely speak up and ask for clarification. You’re not being difficult. In many cases, you’re helping avoid future conflict.

Simple phrases like:
“Could we just clarify that point to avoid misunderstanding later?”

…can save enormous stress down the line.
