🔎 Restrictive Covenants Explained

That non-compete clause might not be worth the paper it is written on.

In Scotland, a restrictive covenant is unenforceable unless it protects a genuine business interest and goes no further than is reasonably necessary.

Our latest article explains what restrictive covenants are, the difference between non-compete, non-solicitation and confidentiality clauses, and when they actually bite.👉 https://www.parissteele.com/news/services-for-business/restrictive-covenants-in-business-what-they-are-and-when-they-can-be-enforced

Have you recorded your funeral wishes?

Many people put their funeral wishes in their Will. It feels like the obvious place. The trouble is that funerals in Scotland usually happen within a week or two, and a Will is often not read until well after that.

Our latest article looks at the options available for recording your funeral wishes and why nominating a person to carry them out is important. 👉 https://www.parissteele.com/news/private-client/where-should-you-write-down-your-funeral-wishes

Where are your title deeds?

If your home is on the Land Register, the honest answer is that there is no physical document to find. Registers of Scotland stopped issuing paper land certificates in December 2014, and the register itself is now the definitive record of your ownership.

If your property is still in the General Register of Sasines, established in 1617 and the oldest register of its kind in the world, the paper deeds do still matter, and they are usually with the solicitor who acted on your purchase.

Our latest article explains the difference between the two registers, where your deeds are likely to be, and how to get a copy. 👉 https://www.parissteele.com/news/residential-property/where-will-i-find-my-title-deeds

Worried that divorce means handing over half your pension?

In Scotland, only the part built up between the date of your marriage and the date you separated counts as matrimonial property and counted for sharing.

Years of saving before the wedding, and anything added after you stopped living together, are generally left out. It is a meaningful difference from the position south of the border, and it catches people out in both directions.

Our latest article explains how pensions are valued and shared on divorce in Scotland. 👉 https://www.parissteele.com/news/family-law/what-happens-to-my-pension-if-i-divorce

Paris Steele’s latest article looks at what to weigh up before you hand money over; whether you can genuinely afford it, how the tax allowances work, and why the seven-year rule will not protect you from a care assessment in Scotland. 👉 https://www.parissteele.com/news/private-client/gifting-money-during-your-lifetime-what-to-consider-before-you-hand-it-over
