❗Vulnerable Adults & Will Disputes

A recent Glasgow Sheriff Court case is a powerful reminder of the risks involved in DIY Wills – especially where vulnerability, family pressure and questions of influence arise.

In Scott v Reeves and Others, the Court set aside a homemade Will after finding it had been obtained through facility, circumvention and undue influence. Importantly, the case shows that even where someone has legal capacity, a Will can still be challenged if improper pressure has been applied.
