Ian Mallon Solicitors have recently settled a personal Injury case at the Dublin High Court for €290,000.00 plus costs.

The client had his accident in Northern Ireland but as the Defendant’s vehicle was registered in the Republic of Ireland, he was able to take his case via the Irish Courts, thereby obtaining a significantly higher settlement figure than had the case been brought in Northern Ireland.

This case illustrates the importance of being able to take a case in the correct jurisdiction.

Ian Mallon Solicitors have recently settled 2 High Court Personal Injury cases.

Both clients suffered serious injuries at work. The first was as a result of a fall from a roof resulting in a fractured hip, requiring surgery. Liability was accepted and the case was progressed to a settlement meeting where damages were agreed in the sum of €210,000.00 plus costs.

The second case involved an injury suffered whilst inflating a wheel resulting in facial injuries, fractures and scarring. Liability was accepted after discussions. This settled for €275,000.00 at a settlement at the High Court.

Both accidents occurred due to serious breaches of work place health & safety requirements and could easily have been prevented with proper safety measures and training.

Ian Mallon Solicitors recently settled a Mesothelioma case in the Dublin High Court.

We acted for a client who was exposed to asbestos during his work over a period of time in the 1970′ and 1980’s whilst working for various employers as a plumber.

Despite being aware of the risk of exposure to Asbestos, the employers took no proper health and safety precautions to protect their employees.

The matter settled for a substantial sum to the satisfaction of the client.

Ian Mallon Solicitors have recently acted for a family who had their home damaged during an oil delivery.

The oil delivery company negligently caused a spillage which impacted the property causing significant loss and damage throughout.

Following the issue of High Court proceedings, the matter proceeded to mediation, where a substantial settlement was accepted by the Plaintiffs.

The property will now be restored so as to avoid any blight on the market value and the claimants were compensated for the distress caused.

A number of experts were retained so as to properly set out the basis for the claim and quantify the loss.

The substantial settlement achieved is reflective of the necessity for claimants to retain Solicitors with expertise and experience in such complex claims.

Ian Mallon Solicitors have recently settled a medical malpractice claim against the HSE.

The case involved the incorrect fitting of a Plaster of Paris causing severe damage to the injured area. The client suffered loss of use of the limb as a result.

The case was presented with detailed medical evidence setting out how the Hospital was negligent as well as having evidence from a number of experts setting out the financial losses incurred to date and into the future.

When presenting such cases (which cannot be dealt with by the Injuries Board) it is important to instruct Solicitors who retain the correct experts to prove liability as well as to set out the full losses suffered by a claimant.
