A Will is a legal declaration by which a person names one or more persons to manage his/her estate and provides for the transfer of his / her property at death. It is possible to write a Will without a solicitor's help, however this would not be advisable as there are various legal formalities which must be followed in order to ensure that your Will is valid. Fountain Solicitors deal with appeals against decisions made by the UK Border Agency to deport or exclude, someone from the United Kingdom on national security grounds, or for other public interest reasons. We also deal with appeals against decisions to deprive persons of citizenship status. The Secretary of State may deprive an individuals citizenship on the basis that it would be conducive to the public good. Where the Secretary of State has certified that the decision to deprive was based wholly or partly in reliance on information which he believes should not be made public, the appeal is heard by Special Immigration Appeals Commission (SIAC). We at Fountain Solicitors can represent you at such appeals and specialise in such matters. The Solicitor who deals with these cases has dealt with many such cases at SIAC, Court of Appeal and Supreme Court. The presumption is that SIAC hearings are heard in open court and the public and press can attend. The judge can decide to hear evidence in closed sessions. In this case the public and press would be asked to leave. The Secretary of State may wish to rely on material which he or she objects to disclosing to the appellant or his representative for reasons of national security or public interest. In such cases, Section 6 of the SIAC Act 1997 allows for a Special Advocate to be appointed to represnt the interests of the appellant in an appeal hearing before SIAC. The cases which our National Security team cover are :

4. Exclusion from the United Kingdom

This position is suitable for applicants:

Preferable with a Law Degree or studying a part-time Law Degree;
or
With a minimum of two years’ experience in a solicitor’s firm
or
With a minimum two years’ experience in an administration role

Applicant must have good organisational skills, know how to conduct themselves in a professional environment and have confidence to meet clients. Applicant will need good IT skills and phone etiquette. The Applicant may also be asked to participate in promotional aspects for the firm so should be familiar with social media.

Duties will involve, but not limited to, performing a variety of administrative duties, including typing and preparation of legal correspondence, answering phones and diary management. There will also be a requirement for reception cover, including post duties.

Home Office: Unlawful Search & Phone Seizure Practices
Between at least April 2020 and 23 November 2020, the Home Office adopted an unpublished “mobile phone policy” whereby migrants who arrived in the UK by small boats were searched and had their mobile phones and SIM cards seized. In some cases, immigration officials demanded PIN numbers and claimed that migrants were legally required to provide this information.
The phones and SIM cards were then retained by the Home Office and, in many cases, data from these devices – including emails, photos and videos - was downloaded by immigration officials.
Under this policy, the Home Office seized almost 2,000 mobile phones.
In HM, MA & KH v Secretary of State for the Home Department [2022] EWHC 695 (Admin), the High Court found that the policy of searching migrants, seizing their phones and downloading their data was unlawful for several reasons, including that the policy was unpublished, breached GDPR and breached the human rights of migrants affected by the policy.
Following a later order by the High Court, a large number of migrants affected by the policy are now starting to receive letters – entitled “notification of unlawful search practices” - from the Criminal & Financial Investigations department of Immigration Enforcement. These letters confirm that the recipient may have been “searched on arrival by Home Office staff… with the intention (amongst other things) of seizing any phone you might have had in your possession”.
The letter states that these actions were unlawful and offers an apology from the Home Office for “any unlawful acts which took place”. As ordered, the letter also advises that “if you have not taken legal advice on your position, you are strongly advised to do so.”
Anyone who has received such a letter from the Home Office or was subject to the Home Office’s unlawful “mobile phones policy” may be entitled to compensation. However, there are time limits for claiming compensation, so it is important that anyone affected contacts a legal adviser as soon as possible.
