A recent case reported in the Northumberland Gazette highlights the devastating consequences that can follow when appropriate measures are not in place to protect workers from falls through fragile roofs.

Unfortunately, this is something we see far too often. What may appear to be a routine task can result in a serious accident, with injuries that can affect someone’s health, career, finances and family life for years to come.

Employers have a responsibility to identify risks, put appropriate safety measures in place and ensure that workers are properly protected.

Cases such as this are an important reminder that workplace safety should never be treated as an afterthought.

FAQ Friday⌛

This is one of our most asked questions and the honest answer is that every claim is different.

Straightforward claims, particularly where liability is admitted at an early stage, may be resolved relatively quickly. More complex cases, such as clinical negligence claims or those involving serious injuries can take longer due to the need to obtain independent expert evidence from multiple experts.

We appreciate that waiting can be frustrating, however taking the time to gather the right evidence is essential to ensure that you receive the compensation you deserve.

At Shaw & Co we will keep you updated throughout your claim and progress your case as efficiently as possible without compromising the quality of your claim.

If you have any questions about making a claim, our team is always happy to help.

JULY SETTLEMENT SPOTLIGHT🌟

This month, we are pleased to have secured successful settlements for clients across a range of personal injury and clinical negligence claims.

⚡ Workplace Accident - Our client suffered serious burns to his hands, arms and face after being electrocuted whilst working on live electrical equipment that should have been isolated. Following debridement, skin grafting and ongoing treatment, liability was admitted and we secured compensation for his significant injuries.

🏥 Clinical Negligence - Following a hospital's failure to adequately monitor the position of our client's wrist fracture, she suffered a worse mal-union, resulting in deformity, ongoing pain and reduced function. Liability was admitted and we successfully recovered damages for the avoidable harm caused.

🛍️ Public Liability - Our client sustained a dislocated elbow after slipping in a shopping centre where there were no wet floor signs and inadequate steps had been taken to reduce the risk of slips. Despite liability being disputed, we negotiated a successful settlement on our client's behalf.

Every case is different, but each represents our commitment to achieving the best possible outcome for our clients.

Recent reports highlighting concerns about neglect and poor standards in care homes are a stark reminder of the duty owed to some of the most vulnerable members of our community.

Unfortunately, our experience shows that these issues are not uncommon. At Shaw & Co Solicitors, we have acted for clients who have suffered avoidable injuries as a result of inadequate supervision, unsafe moving and handling, neglect, and failures to properly assess risks.

These cases highlight the serious consequences when expected standards of care are not met, and the importance of holding care providers accountable where those failings result in injury.

A recent BBC report has highlighted that compensation paid to people injured in incidents involving e-bikes and e-scooters has now exceeded £110 million in the UK, reflecting the increasing number of claims as these modes of transport become more common.

Unlike many traditional road traffic collisions, accidents involving e-bikes can raise complex questions about liability, insurance and who is ultimately responsible for compensating an injured person.

The rise in e-bike use is unlikely to slow down, making it increasingly important for road users to understand their rights and responsibilities.

What are your thoughts on the rapid growth of e-bikes on our roads?

An interesting overseas case that caught our attention because it highlights an issue that is equally familiar here in the UK.

The case concerns a 70-year-old man bringing a $35m claim after suffering catastrophic injuries when he tripped on a metal base left behind after a parking meter had been removed.

While the legal framework differs, the underlying principle is one we regularly encounter: those carrying out works on the highway have a duty to leave the surface in a safe condition for users.

Just days after an elderly man filed a $35 million claim against the city of San Diego after falling on an exposed parking meter base in Mission Hills, the city is taking action to make the street safer.

JUNE SETTLEMENTS SPOTLIGHT⚖️

Delay in Diagnosis & Treatment of Prostate Cancer – The GP failed to investigate blood tests for 2 years, delaying diagnosis and treatment. Following diagnosis, there were delays in discussing alternative treatment options after our client was unable to tolerate a novel therapy. Our client was transferred to another hospital where he was lost to follow up and unfortunately deteriorated and died. Despite liability being disputed, we successfully negotiated a settlement and recovered damages for our client’s family.

Hospital Fall - Our elderly client suffered a fractured hip after falling while an inpatient in hospital. The hospital's own investigation identified inadequate staffing levels on the ward, including concerns regarding the experience and qualifications of staff present at the time of the incident. Following admission of liability, we successfully recovered damages on our client's behalf.

Delay in Surgical Treatment - Our client suffered a lacerated tendon to his hand requiring urgent surgical repair. Despite repeated warnings from secondary care that surgery needed to be performed within a limited timeframe, referrals were repeatedly delayed due to staffing issues and our client was ultimately lost to follow-up. By the time he was finally assessed, the window for successful surgical intervention had passed. As a result, he was left with permanent tendon damage, an irreparable flexion deformity of his finger, and a lasting loss of function. We successfully secured a settlement to compensate our client for the avoidable consequences of these delays.
