One of the classic assumptions people make is that because they're married or own their home together, that the partner will automatically keep the house on first death. This is NOT always the case! It depends on how you own the home, the value of it and the family make up. If you're cohabiting, please make sure that not only do you both have wills in place, but that you have taken professional advice and understand the financial implications for the surviving partner on death of the first. Today is a proud day. I had to work harder for this badge of quality than I have for anything else in my entire academic and professional career. This morning I learned I have passed the STEP Advanced Certificate in Will Preparation (England & Wales). This adds to my affiliate status with STEP, which acknowledges my fabulous worked experience with The Will Guys and my professional background as a Chartered Accountant. Thank you to all those who supported and cheered me along on this. I'm ending 2024 on a definite high!!

Thank you to my lovely client who very recently recommended me to another with the tag "SMBC and will writer extraordinaire"

It made me laugh.

I pursued being a solo-mother-by-choice a few years back and am now cohabiting with my beautiful daughter, lovely partner and mischievous cockapoo. Solo parent and blended families have a few added risks to consider compared to the traditional 2.4 family set up, albeit all parents should make sure they have a will in place.

I've done it again! I think I'll start charging commission to registry offices at this point. 💍 All jokes aside, it's never very comfortable advising your happily-cohabiting clients that on death of one, the survivor is going to have to sell their home while grieving, in order to cover the inheritance tax bill. Imagine my delight when they call me after their will appointment to say they have taken my advice and have finally set a date for their nuptials. The IHT thresholds have stayed the same for years, yet house prices keep on rising, which means more and more cohabiting couples could find themselves caught out by this.

I talk about Lasting Power of Attorney every day, but yesterday I choked up a little advising a client about it. She works for the organisation that runs the care home my mam went to. The care home which looked after her so well in the last 3 years of her life. The one she WOULDN'T have gone to had we not had Lasting Power of Attorney for her and were able to insist she stay in hospital until a bed became available there. Mam was 51 when she was diagnosed with dementia. We had time to make arrangements. Dad wasn't locked out of their joint bank accounts or unable to remortgage their home. That would have been the reality if not for Lasting Power of Attorney. Illnesses or accidents can happen without warning and at any age, so every adult should have this in place, just in case.

A question I ask all of my clients is "Why now?" and these are a number of real responses I've received over the years. Understanding a person's motivation for putting their will in place helps me to provide the best advice and protection for their loved ones. While your will can be fast-tracked if there is an urgent need, it is easier to make decisions without the pressure of big upcoming life events. So, if you have been meaning to write your will for a while, there is no time like the present.
