Yesterday we witnessed yet another occurance when it would have been essential for someone to make the appropriate estate planning provisions whilst they had the opportunity to.

Lynda Bellingham, better known as the Oxo mum, passed away in 2014 battling cancer, since then, her widower has taken upon himself to enjoy her legacy through lavish holidays and high-end purchases, whilst her two sons from her previous marriage are left with absolutely nothing. Michael Pattemore, who in effect disowned his two step children also evicted them from their family home even though he made a promise to look after them.

Scenarios like this happen regularly, where the children from a previous marriage are disinherited due to decisions made by their step-parents. If appropriate estate planning provisions have been made through a professional, this could have been avoided all together.

Yesterday the government has published their consultation report on changing probate fees; in order to raise a sum of £250million pounds to see the justice and court systems be improved.

However, the money being raised are to come from family members who has recently lost a loved one, through the process of probate.

At present, the fees are set at £155 for solicitors and £215 for individuals for estates over £5,000; The new report introduced would mean any estates between £50,000-£300,000 be charged £300. Between £300,000.01-£500,000 the fee will be £1,000; below £1 million, £4,000; below £1.6 million £8,000; below £2 million, £12,000 and for above £2 million, £20,000. For the majority of the population, this could mean an increase cost in probate fees by 140% to 465% alone, disregarding any other costs which are involved through the process. (Price for individuals with an estate of between £50,000-£500,000)
