We are pleased to confirm that we have successfully pursued a wasted costs order against the Home Office following a late withdrawal of appeal. The Tribunal found that the conduct of the Home Office during the proceedings was unreasonable, resulting in unnecessary expenditure and delay.
The wasted costs order reflects the failure by the Home Office to properly discharge its duties during the initial stages of the case, leading to avoidable litigation and a successful appeal. The Tribunal’s decision reinforces the importance of procedural fairness and accountability in public decision-making.
This outcome not only secures reimbursement for the unjustified legal costs incurred but also underscores the need for higher standards in the conduct of government departments during immigration proceedings.
Thanks to our immigration team Tuhin Pahlowan Solicitor Muhammad Chan Rahman and Luthfa Begum for their hard work at Birstall Myers Solicitors Ltd
