How One Simple Mistake Could Cost You Your Home

This week, one of our advisers met with Tim and Sarah to discuss their wills. What seemed like a simple task quickly revealed some serious issues that could have cost them their home.

Tim and Sarah have children, some savings, and a property they’ve been paying the mortgage on for 10 years. But there was one key detail they hadn’t thought about: the property is in Tim’s mum’s name, not theirs.

When they began the process 10 years ago buying a house, they couldn’t get a mortgage on their own, even though they had a large deposit saved. Tim’s mum helped by raising the mortgage in her name, with Tim and Sarah paying her back each month. They assumed that once the mortgage was paid off, the house would simply transfer to them, or that it would pass to them after Tim’s mum passed away.

Here’s where things get complicated:

Capital Gains Tax – Because the property isn’t Tim’s mum’s main residence, it could be hit with a large capital gains tax bill when it’s transferred to Tim and Sarah. Without the right paperwork, the tax burden could be significant.

Inheritance Risk – Tim’s mum remarried after purchasing the property. Since marriage revokes a Will, her estate would pass intestate (without a Will). This means Tim and Sarah could lose the property to their mum’s new husband, depending on inheritance thresholds.

Fortunately, we were able to help Tim and Sarah by connecting them with one of our trusted partner solicitors to formalise the arrangement and ensure they’re protected.
