Abbott Solicitors successfully secured the future of an international PhD student through urgent High Court proceedings after his academic career and immigration status were placed at immediate risk.
Our client, an international doctoral researcher, sought our assistance after his university reported him to the Home Office, resulting in the curtailment of his Student visa. This decision threatened to bring an abrupt end to his studies despite the fact that he had already invested more than £45,000 in tuition fees, had successfully completed almost two years of his PhD programme, and had made significant academic progress towards the completion of his research.
By the time the client instructed Abbott Solicitors, his immigration position had become extremely urgent. His curtailed leave was due to expire on 26 June 2026, leaving him with less than one month to challenge the university's actions and avoid becoming an overstayer. Given the imminent expiry of the client's leave, we also made an urgent application for interim relief seeking to prevent the consequences of the university's reporting decision until the lawfulness of that decision could be determined.
The High Court granted interim relief by suspending the effect of the university's report to the Home Office. This provided the vital legal protection needed to preserve our client's immigration status while the dispute was being resolved.
Following the Court's intervention, Abbott Solicitors engaged urgently and constructively with both the university and the Home Office. Through persistent legal representations and strategic negotiations, we secured the withdrawal of the reporting decision and the restoration of our client's original immigration leave on the very day his curtailed leave was due to expire. As a result, he avoided becoming an overstayer, retained his lawful immigration status without interruption, and was able to continue his doctoral studies.
