Do I need to change my Will when my spouse dies?

This is a question we’re asked often—and while the answer depends on your individual circumstances, there are some important things to consider.

A well-drafted Will should already account for the possibility of a spouse’s death, with provisions in place for other beneficiaries such as children, family members, or charities. However, it’s still wise to review your Will regularly to ensure it reflects your current wishes.

We recommend reviewing your Will every five years, and especially after major life events like a birth or death in the family.

If you're unsure whether your Will needs updating, we're here to help.

🏡 Thinking of transferring your home to your children to avoid care fees?

At Lees & Co Law, we’re often asked whether parents should gift their house to their children to protect it from care costs. It sounds simple—but it’s rarely a good idea.

Here’s why you shouldn’t:
❌ It can be seen as deliberate deprivation of assets - Local authorities may still assess the value of your home when calculating care fees, even if it’s no longer in your name.
❌ You lose control - Once the house is transferred, your child legally owns it. If they divorce, go bankrupt, or fall out with you, your home could be at risk.
❌ Tax consequences - You could trigger unexpected capital gains tax or inheritance tax issues down the line.

✅ The right advice can help you protect your assets legally and ethically—without putting your future security at risk.

Care fee planning is complex, and every family’s situation is different. Before making any big decisions, speak to a professional who understands the law and the long-term implications.
