Is Long Covid a Disability under the Equality Act 2010?

Long Covid and the symptoms are widespread including: fatigue, breathlessness, brain fog, dizziness, chest pains, insomnia, depression and anxiety.

Under the law, a disability is a physical or mental impairment that has a 'substantial and long-term' negative effect on a person's ability to do normal day-to-day activities.

'Long term' means the impairment has lasted or will last for at least 12 months or can come and go or is likely to last for the rest of the person’s life.

There is no definitive answer as to whether Long Covid is classed as a Disability under the Equality Act at this stage and ACAS suggests employers focus on making reasonable adjustments and providing a supportive environment rather than trying to work out if an employee’s condition is a disability.

Hybrid working is here to stay but do you have the correct policies in place to support such working practices?

A policy to support Hybrid Working arrangements is important not only does it lay out employers’ expectations whilst working at home, but it provides consistency for all employees.

When developing a Hybrid Working Policy, employers need to ask themselves:

1. Do you intend to trial hybrid working arrangements in the first instance?
2. Will all employees be able to have such arrangements, or will it only apply to certain job roles?
3. Can hybrid working only take place at the individual’s home or can employees work from another location?
4. Is there a set number of days per week you would like employees to attend the workplace?
5. Will meetings still take place in person?
6. Will your absence management procedures be impacted by this change?
