In Part I, we introduced the Homes (Fitness for Human Habitation) Act 2019, emphasising safe and healthy living conditions. Now, let's delve deeper into specific rights and responsibilities outlined by this crucial legislation.
Effective Dates:
From 20 March 2019: New tenancy agreements or periodic tenancies from this date, including tenancies shorter than 7 years, can use the Homes Act.
From 20 March 2020: Applies to secure/assured tenancies, statutory tenancies, or private periodic tenancies, regardless of start date.
What types not covered: It doesn't cover those with 'licences to occupy', like lodgers or some temporary accommodation situations.
Landlord’s duties and responsibilities:
Landlord's Duty: Landlords must maintain properties to be safe and fit for habitation.
Right of Access: Landlords should provide at least 24 hours' notice for non-emergency access.
Responsibility for Repairs: If a problem is due to tenant behaviour, the landlord may not have to fix it.
Exceptions to Landlord Responsibilities:
Problems caused by tenant behaviour.
Events beyond the landlord's control (e.g., natural disasters).
Landlord not responsible for tenant's possessions or previous tenants' furniture.
