The Ministry of Justice has developed a mediation voucher scheme, whereby a contribution of up to £500 per case/family to the mediation costs of a child arrangements case will be offered, encouraging people to seek to resolve their disputes outside of court where appropriate to do so.

The purpose of the scheme is to promote the benefits of mediation and divert matters where appropriate away from the family courts. The scheme will offer mediation participants a financial contribution of up to £500 per family towards the total costs of their mediation.

The Ministry of Justice has provided £1.8m for family mediaiton, up to £500 for each family towards child issues mediation sessions. We also offer legal aid for those on benefits or on a low income.

Trying to work out who has what?

When you are divorcing or separating it is difficult to work out who has what. There is so much to talk through: pensions, benefits, insurance, ISAs, income, maintenance, bills, mortgage and much more. It can also be difficult emotionally to work together on sorting out the end of the relationship.

Do you know what your children think about your separation?

Separation is not easy. When you are an adult and your ex tells you they are leaving its like being hit by a bus. It doesn’t feel any different when you are a child you just can’t do anything to make it better.

Child Inclusive Mediation (CIM) gives children the opportunity to say what they think about divorce or separation and how it affects them. The mediator is trained to hear what they say and helps parents to work out what to do with the information. In CIM the children know they can’t decide what will happen or where they live but they have a voice. They are being listened too, they can know their parents trying to get things right for them.

During separation and divorce most parents aim is to do what’s best for their children. Hearing what their children say will help parents be confident that they can achieve that goal.

An independent and impartial mediator can help parents make decisions for all the family.

Mediation is free to those eligible. The ex-partner also benefits as the Mediation Information and Assessment Meeting (MIAM) and the first mediation meeting will be free of charge for both.

Mediated Dispute Solutions has just secured a contract from the Legal Aid Agency to provide publicly-funded family mediation services. The Legal Agency provides publicly-funded mediation through mediators accredited by the Family Mediation Council (those who hold FMCA) and have a contract from the Legal Aid Agency.

If you think you or your ex partner may be eligible for legal aid you can use the ‘Can you get legal aid ‘ tool on the Ministry of Justice website. Go to www.gov.uk when you enter the site, click ‘Start Now’; choose ‘Family’; choose ‘Family Mediation’; click ‘Yes’; click ‘Check if you qualify financially’. Enter details in calculator.

If you are unsure about your eligibility please contact us. The latest guidance allows mediators to do the eligibility check on the phone or video conference. The evidential documentation and the Legal Aid Application form can be signed and sent in the post.
