🇬🇧 UK Immigration Update: Changes taking effect today

8 October 2026 marks an important date in the UK Immigration Rules, with several changes introduced under the Government's latest Statement of Changes, HC 584.

Here are some of the key changes taking effect today:

🔹 Skilled Workers and modern slavery

Eligible Skilled Workers recognised as victims of modern slavery can, in specified circumstances, have their work conditions amended. This can allow them to work for any employer, undertake self-employment or voluntary work for the remainder of their existing permission.

🔹 Adult dependent children and domestic abuse

The Victim of Domestic Abuse route is being extended to qualifying adult dependent children in certain circumstances where their relationship with their parent or parent's partner has permanently broken down because of domestic abuse.

🔹 Erasmus+

Changes are being introduced to support the UK's participation in the Erasmus+ programme, including changes to permitted activities under the Visitor, Student and Government Authorised Exchange routes.

🔹 Hong Kong BN(O) route

Changes are also being made concerning certain dependants under the Hong Kong British National (Overseas) route.

⚠️ Important: These are some of the key changes taking effect today. HC 584 contains other amendments, and not all of them start on the same date.

Further changes are scheduled for 29 October, 30 November and 9 December 2026.

⚖️ A difficult immigration case has helped bring about a change to the Immigration Rules

A recent High Court case has resulted in an important change for adult dependent children experiencing domestic abuse.

In JR337 Application for Judicial Review [2026] NIKB 12, the Northern Ireland High Court found that the Migrant Victims of Domestic Abuse Concession was unlawful as applied to the applicant.

The applicant was a young woman who had come to the UK as a dependent child. After turning 18, she alleged that she had experienced domestic abuse within her family.

The case highlighted a gap in the immigration protections available to certain adult dependent children.

Following the judgment, the Home Office has amended the Immigration Rules.

From 8 October 2026:

Adult dependent children may be able to use the Victim of Domestic Abuse route where the relevant relationship with their parent or parent's partner has permanently broken down because of domestic abuse.

They can apply:

🔹 At the same time as their parent; or
🔹 After their parent has applied.

The change applies to qualifying applicants who meet the requirements of the amended Appendix Victim of Domestic Abuse.

This case is a useful reminder that immigration law can be complex, particularly where someone's immigration status depends on a family relationship that has broken down because of abuse.

The judgment in JR337 was delivered on 27 March 2026, and the Immigration Rules change is due to take effect on 8 October 2026.

New Home Office guidance on children and British citizenship

The Home Office has updated its guidance on registering children as British citizens to address circumstances involving a same-sex relationship with a British citizen.

The guidance explains that, for British nationality purposes, the mother is the woman who gives birth to the child, whether or not she is biologically related to the child.

Since 6 April 2009, the Human Fertilisation and Embryology Act 2008 can allow the mother's female partner to be treated as the child's parent in certain circumstances.

This can apply where, for example:

🔹 She was married to or in a civil partnership with the birth mother at the time of fertility treatment; or

🔹 The treatment took place at a UK-licensed clinic and the relevant legal requirements are met.

Where the female partner is treated as the child's parent for nationality purposes, the child may already be a British citizen automatically or may be able to register as a British citizen.

The updated guidance also explains circumstances where the British female partner is not treated as the child's parent under nationality law, but registration may nevertheless be appropriate.

⚠️ Important: This does not mean that every child in a same-sex family with a British parent automatically becomes British. The child's circumstances and the relevant nationality provisions must be considered.

🇬🇧 New temporary protection for adult social care workers

The Home Office has published a new temporary arrangement affecting certain adult social care workers whose sponsor has had their sponsor licence revoked.

Under the updated Cancellation and curtailment of permission caseworker guidance, Home Office caseworkers must not cancel a person's immigration permission solely because their sponsor's licence has been revoked where the person:

🔹 Holds permission under the Skilled Worker or Health and Care Worker route
🔹 Is working as a care worker (SOC 6135 or 6145), or
🔹 Is working as a senior care worker (SOC 6136 or 6146).

The arrangement is specifically described by the Home Office as temporary and subject to regular review.

⚠️ If there is another reason for cancellation, the Home Office must consider cancellation in the usual way.

This is particularly relevant given the usual position that workers can have their immigration permission cancelled or shortened when their sponsor loses its licence.

📌 Important: The new guidance concerns cancellation of immigration permission. It does not state that affected workers automatically have permission to work for a different employer.

The guidance was published for Home Office staff on 11 September 2026 and the GOV.UK page was updated on 14 September 2026.

🇬🇧 Student visa financial requirement is increasing

International students planning to study in the UK should be aware of an upcoming change to the Immigration Rules.

From 30 November 2026, the amount students must normally show for living costs will increase.

New monthly amounts:

📍 Studying in London
£1,570 per month

📍 Studying outside London
£1,203 per month

The requirement applies for up to 9 months, meaning students may need to demonstrate:

London: up to £14,130
Outside London: up to £10,827

The current amounts are £1,529 per month in London and £1,171 outside London.

The Home Office says the annual uplift is intended to keep the Student route maintenance requirement aligned with the maintenance loans available to home students.

📅 Effective from: 30 November 2026

New Protection for Eligible Skilled Workers Facing Modern Slavery

A significant change to the UK Immigration Rules will provide greater flexibility for certain Skilled Workers who have been recognised as victims of modern slavery.

From 8 October 2026, eligible Skilled Workers who have been referred to the National Referral Mechanism (NRM) and receive a positive Conclusive Grounds decision during their most recent period of permission may have their work conditions amended.

This can allow them to:

✅ Work for any employer
✅ Undertake self-employed work
✅ Undertake voluntary work

The change applies for the remaining duration of their existing immigration permission.

There is an exception for work as a professional sportsperson or sports coach.

The Home Office says the change is intended to encourage victims to come forward and reduce the risk of vulnerable workers being exploited through the sponsorship system.

The devastating floods and landslides affecting Nepal have left communities facing an unimaginable situation.

Since 26 August, severe flooding in the Rasuwa district and areas around the Nepal–China border has caused widespread destruction, affecting homes, roads, bridges, communications and essential infrastructure. Hundreds of people have lost their lives and thousands remain missing as rescue efforts continue.

For the Nepali community here in the UK, these events will be particularly difficult as families wait for news of loved ones and communities come together to support those affected.

The UK Government has announced £5 million in humanitarian support for Nepal and has deployed additional consular staff to assist British nationals and their families affected by the disaster.

🎓 **STUDENT SPONSORS: ARE YOU READY FOR THE TOUGHER COMPLIANCE STANDARDS?**

The Home Office has recently demonstrated that Student sponsor compliance is being taken seriously.

On 5 August 2026, the Student sponsor licence of Bloomsbury Institute was revoked after the institution failed its Basic Compliance Assessment.

The timing is particularly important because Student sponsor compliance standards were strengthened from **1 June 2026**.

Sponsors are now subject to:

📌 Visa refusal rate below 5%
📌 Course enrolment rate of at least 95%
📌 Course completion rate of at least 85%

And from assessments submitted from **June 2027**, the course completion threshold will increase to at least **90%**.

For education providers, this is an important reminder that holding a Student sponsor licence comes with ongoing responsibilities.

Failure to meet the required standards can result in enforcement action, including the loss of the sponsor licence.

The Home Office has said its priority is to protect students and the integrity of the Student route.
