We are extremely pleased that the lawyer behind Leaseholder Action, Liam Spender, has won a significant Court of Appeal victory which could result in a reduction in the service charges paid by hundreds of thousands of leaseholders in England and Wales.

This ruling clearly shows that freeholders and managing agents must be able to justify what they charge and that they cannot rely on opaque or outdated arrangements without proper explanation.

This same question of transparency lies at the core of Leaseholder Action.

The government has opened a consultation on reforming the home buying and selling process.

A key part of the consultation looks at leasehold sales information - including whether important details such as service charges should be made available to buyers upfront.

Service charges are a vital part of understanding the real cost of owning a leasehold property. This includes the charges for buildings insurance where landlords now must declare some of their commission. The fact that this was previously done completely in secret is at the heart of the Leaseholder Action claim.

In complex and costly litigation, individuals often face barriers to justice.

In his latest blog, Liam Spender, the lawyer behind the Leaseholder Action claim, reflects on why - in cases like Adriatic Land 5 Limited v Long Leaseholders of Hippersley Point - collective action is often the only viable route to redress.

A judicial review of the Leasehold and Freehold Reform Act is underway at the Royal Courts of Justice.

Freeholders like Long Harbour and GRIF are challenging reforms designed to change the leasehold system, including more transparent service charges - arguing the changes breach their human rights.

Leaseholders have no direct voice in the courtroom, but we are following the case closely and continuing to act.

Leaseholder Action is taking on block owners and insurance brokers for making secret deals that may have increased your insurance charges by up to 60%.
