Another charity under investigation by the for England and Wales. Many charity trustees do not appreciate the severity and the gravity of their roles as trustees. Few demonstrate sound understanding of the legal duty which come with their office and the implications which can follow for failure to adhere to such duty. We also find that in most cases, trustees are well intentioned, and genuinely did not want to act in a manner that is less than fitting for a trustee (act or omission) but issues arise because of the lack of knowledge and appreciation of their legal duty and how it plays out in practice. Not all charities who fail in their duty are investigated by the Charity Commission, but those who are investigated and where issues are identified, the consequences of such findings can be devastating.
It is therefore really important for a charity to ensure it has the right governance framework in place, appropriately robust arrangement for reviewing and auditing as well as competent professional support to guide and assist the charity. When a charity is investigated, again, it is really important to have appropriately qualified professional assistance to deal with the investigation and mitigate any fall out which may arise as a result.
