Are you looking to take the next step in your legal career? We are seeking a Legal Assistant to support our growing team. This role offers a unique opportunity to work with a UK Top 60 law firm and gain valuable experience in Residential Property and Immigration law.

Qualifications & Skills:
* A law degree, CILEX, Chartered Conveyancer qualification is desirable but not mandatory.
* Right to work in the UK.
* Fluent in Cantonese and English.
* Strong understanding of legal terminology and procedures.
* Excellent organizational skills and attention to detail.
* Strong written and verbal communication abilities.
* Ability to prioritize tasks and manage multiple projects under tight deadlines.
* Proficient in Microsoft Office Suite and legal software (experience with MatterSphere is a plus).

Scope of Work:
* Legal Assistance:

* Drafting and preparing legal documents, letters, and contracts.
* Managing and organizing files, both electronic and physical, ensuring confidentiality and accuracy.
* Conducting legal research to support ongoing cases.
* Liaising with clients, courts, and external parties in a professional and timely manner.
* Managing calendars, appointments, and deadlines for legal staff.
* Handling administrative duties including file maintenance, case following, and correspondence.

* Assisting in marketing activities and maintaining professional relationships with external stakeholders.

2025印花稅加價❓點部署❓

在英國買樓時需要繳付印花稅Stamp Duty Land Tax。
印花稅在2025年3月底有可能增加，回到到2022年前的水平。

如果你購買的物業在2025年3月31日後成交的話便需要繳交較高的印花稅，而平均多繳的稅項為2500英鎊。（下圖）

英國政府在2022年為刺激樓市及經濟，將印花稅的門檻暫時提高; 如果樓價為 250,000英鎊以下不需要繳付印花稅; 如首次置業買家First Time Buyer的印花稅門檻更增加到425,000英鎊。

但是，此政策只為期兩年半‼️市場一般預期是屆政府會增加稅收，將印花稅回復到2022年較高水平;

雖然現時距離25年3月尚有半年時間，但是在英國置業過程需時一般12至16星期，如果買的是leasehold或chain的話則需要更長時間！

點部署?⚠️🧐

在法律界工作超過超過八年時間，我發現每次政府有新稅務政策大家都會last minute入市或離市！

我相信到年底的時候將會有大批希望省印花稅的買家deadline fighter式入市, 令銀行律師等相當繁忙，可能需時更長！

但是要留意律師並不能保證會在deadline前可以完成交易啊！因為整個交易過程涉及多個合作單位,如賣方律師,surveyor,管理公司,local council等等，並不是所有人的工作進度也在你律師的控制範圍以內呢！

有需要買樓或賣樓請盡早作出部署，找你的律師傾傾！

另外，是屆政府亦有可能在秋季預算宣布時 （10月30日）增加物業利得稅Capital Gain Tax，（現時為18至24%），換言之如果買家在此後出售的非自住物業，所賺到的差額可能需要付較高的稅項。

Ordinary Residence 陷阱

X女士在外地讀書數年，近年與外地丈夫在當地結婚，並育有一子。在小孩出生後X女士自行在外地申請BNO visa，但UKVI 英國簽證部以X女士並非香港Ordinary resident（通常居民）為理由拒絕了她一家的申請。

X女士於是決定舉家到英國跟家人團聚，再行打算。

我們深入研究X女士的背景和上一次被拒簽的文件，決定在英國再幫他們重新申請；仔細陳請他們的背景，如何已符合申請要求，亦提交充份文件(supporting documents)支持。 在遞交申請大概一個多月便收到好消息，她們一家三口的留英申請都成功批准了！

Ordinary Residence

近年筆者收到越來越多因為非Ordinary Resident被拒簽的求助個案； 申請人雖然在外地工作或讀書，理應符合要求； 但case worker 往往因為申請人在外時間太長、在外打工或申請者未能提出實質證據證明自己符合Ordinary Resident的要求而拒簽。

一般case worker會要求申請人提供進一步證據證明申請者Ordinary Resident的身分，但由於申請者往往不了解要如何需要證明，隨便交了些文件或答覆幾句； 最後被拒簽。

BNO申請的guideline雖然有提到何謂Ordinary Residence ，但此要求的定義（definition ）存在很多法律上的灰色地帶，很多申請人未必充分了解提出證據的重要性 (burden of proof)。

需知道簽證申請始終有其法律上的複雜性和技術性，如果你的申請涉及Ordinary Resident或其他比較複雜的元素，請先做好調查或請律師協助處理。

後記：

X女士是在網上看到Catherine的介紹便發了個電郵給我，經過一個多小時的諮詢後決定委託我去辦理她們一家的簽證申請。

記得網上見面的時候，X女士和丈夫情緒很繃緊，因為孩子很小，如果申請再失敗要回去外地定居也不是他們想要的結果。丈夫邊說時更不禁流下眼淚； 我安慰他們說不要擔心我一定會盡力幫你們的！

現在他們一家可以在英國定居和家人團聚，我們也鬆了一口大氣！

真實對話。

似乎地產中介對買家的資金來源審查越來越嚴謹；但又未有足夠能力去review 文件。我的另外一位客戶甚至因為未能“滿足”中介要求被withdrawn offer ，直到我向他們confirm律師樓這邊已完全成審查方休！（我也不明白這操作，反正就是delay了1個月有多！）

建議客戶盡量配合中介，或者請你律師協助。

EA: so regarding the clients source of fund, as he is from overseas i have got my colleague to speak to him as they speak the same language...and it involves the exchange rate. i'm just wondering if you have received anything to read yet.
Me: no i haven't he hasn't given me the instruction yet, we just had a brief chat.
EA: Ok...
Me: If it's the exchange rate then you can just google it...
EA: yea thought i could do that.

EA: Also, there will be a reservation fee of £750+VAT
Me: ok that's between the seller and buyer we won't enforce it... but why's there a VAT?
EA: What do you mean?
Me: its not a taxable service or product, it's a reservation fee. Why would you add VAT to it?

搵工陷阱

今日係群組裏面見到個post [已經即刻Delete]，睇左條片30秒，片中人話自己當年山窮水盡但都用左$7,000 買片中美容產品。

提醒各位係英國開展新生活嘅朋友，明白大家初到外地搵工唔容易加上經濟壓力，都切記唔好因為心急而中咗騙徒既圈套。

有好多騙子睇中心急搵工嘅人，要求佢哋交出個人資料、繳付保證金等方法去進行欺詐。

如果有搵工嘅需要可以去Jobs Centre ，或者一啲社區中心求助。

唔好介意開頭人工比較低或者唔係自己本行，因為一份工作除左人工，仲可以幫你擴闊人脈!

如果各位雇主或雇員，在雇傭合約或勞工福利方面嘅問題歡迎聯絡我資詢法律意見。

順帶一提，簽證持有者在英國不能申請大部份社會福利，（其中一項簽證條件‘no public funds’）例如：

Zoom網上核證文件服務

疫情嚴峻，如有需要核證文件 (certify documents)又不能外出，可以使用我們的Zoom網上核證文件服務。

我們的核證文件服務由*英國註冊律師*為客戶提供, 以供客戶在英國置業或開立銀行戶口等需要時正式使用。可以認證文件如：

-各項住址證明
-有效護照

已核證的文件副本會註有下列資料：
"-Certified to be a true copy of the original"
-簽署並註明日子
-核證人職業 (solicitor) ，地址，聯絡電話
費用為每份$200起。

註：
簡單來說，核證文件是由核證人員證實某文件副本和正本是相同的。

英國法例並沒有指定核證文件的相關程序（如必須面見），唯說明只有特定人士，如律師或其他專業人士，方可核證文件。一般用作英國置業的文件如護照、地址證明等，英國律師事務所都接受由註冊律師（香港或英國）核證的文件。
