Success for Care Worker's Family, even though they were not eligible under the New Rules! We’re pleased to share that leave to remain has been granted to the dependant partner and children of a migrant on a Health and Care visa, even though they were not eligible under SOC 6135 as per the new Immigration Rules.The lead applicant had recently switched from a Student visa to a Health and Care visa under the new rules, which explicitly restrict the right to bring dependants.From the outset, we clearly advised the client that their partner and children were not eligible under the new policy.However, in our legal representations:🔹 We submitted detailed arguments highlighting the family’s circumstances and the disproportionate impact of forced separation.🔹 We warned the Home Office that any refusal would be challenged, including a broader legal challenge to the discriminatory nature of the new rules, which prohibit care workers under SOC 6135 from bringing dependants, while other Skilled Workers (non-care) under the Immigration Rules: Appendix Skilled Worker are allowed to do so.🔹 The Home Office granted leave — a significant and just outcome given the policy landscape.We are also pleased to share that we have since received another positive outcome in a similar case — and extend our gratitude to the client for their video testimonial.🙏 Thank you to the client for your trust and support.📽️ Watch the testimonial to hear firsthand how NARA Solicitors supported them during a complex and uncertain process.Great Work by Alisha Badhran

Migrants Living in England Can File for Divorce!

We’re pleased to share that divorce has been successfully granted to a migrant living in England on a Graduate Route (PSW) visa, even though the respondent wife resides in India.

The marriage was solemnised in Haryana, India under Hindu law (Hindu Marriage Act, 1955).

Let’s bust two common myths:

✅ Myth Busted: “You must file for divorce in your home country if the marriage took place abroad.”

❌ Not true. If you're habitually resident in England, you can file for divorce here — even if your spouse lives overseas.

✅ Myth Busted: “I am a migrant, not settled in the UK, so I can’t file for divorce here.”

❌ Wrong again. Your immigration status does not need to be permanent. What matters is habitual residence in England.
