NMC Restoration Victory

Xmas celebration came early for the client I represented yesterday.

I represented a registered nurse who had been struck off the NMC register in 2017. The NMC Lawyer had argued that my client had provided limited reflection.

I submitted to the Panel, that my client had already addressed the concerns raised by the previous panel in respect of her insight and remediation, therefore she no longer poses a significant risk of repeating her previous actions.

Following her oral evidence and my submissions, the Panel restored her on the NMC register, subject to the completion of her return to nursing practice course.

To God Almighty be the glory.

NB: Please note that the client was not represented by me at the time she was struck off the NMC register.

DOUBLE CELEBRATION - NMC Restoration Victory

I was so delighted to have won two restoration hearings one after another. To Almighty God be the glory.

On the 12th April & 9th May 2023, I represented a registered nurse who had been struck off the NMC register in 2017. The NMC Lawyer asked the Panel to consider whether my client had demonstrated sufficient evidence that she is fit to practise.

I later submitted to the Panel, the remedial steps that had already been taken by my client in the last 6 years and how she does not pose any further risk of repeating the similar behaviour.

Following her oral evidence and my submissions, the Panel restored her on the NMC register, subject to the completion of her return to nursing practice course.

On 6th of June 2023, I also represented a Learning Disability nurse who was struck off the register about 7 years ago.

I made submissions to the panel on my client’s level of insight into her misconduct and how it would be in the public interest to permit her to return to the nursing profession. I invited the Panel to grant the application to restore her to the NMC register and the Panel did so, subject to her completion of a return to practice course.

Please note that the two clients were not represented by me at the time they were struck off the NMC register.

I received this feedback from a client on another NMC case we recently won.

Last Thursday, we received a “no case to answer" decision from the NMC at the investigatory stage, following my written legal submissions. My client was so delighted that the case was dismissed so early in the process, and did not reach the hearing stage.

TO GOD BE THE GLORY

Yesterday, I represented a former registered nurse at the virtual NMC restoration hearing, despite currently being on holiday in America. This is what happens when you turn your passion into a business.

He was struck off the NMC register in 2016. Please note that he was not represented by me or my firm at this point.

At the restoration hearing, the NMC Lawyer made submissions that the panel should consider imposing a conditions of practice order before my client is able to return to practice, unrestricted.

I opposed her submissions & made my own comprehensive rebuttal to the panel regarding why a conditions of practice order would not be appropriate in this case. I also made submissions to the panel regarding why I believed my client is now ready to be restored on the NMC register.

The panel leaned towards my submissions and decided to restore my client to the NMC register, subject to the completion of his Return to Nursing course.

Both of us are extremely delighted with the outcome as the pain of seven years has now come to an end.

TO GOD BE THE GLORY - FIRST VICTORY IN 2023

My sincere thanks to everyone for your prayers and best wishes during my 7-day NMC hearing. I’m delighted to inform you that I secured victory for the nurse on the final day.The NMC hearing is a 3-stage process - fact stage, impairment stage & sanction stage.

At the second stage of the hearing which was the impairment stage, the NMC Lawyer made submissions to the Panel that the fitness to practice of my client was impaired. In response to this, I made my own robust and comprehensive submissions to the Panel that the fitness to practice of my client was not impaired due to her level of insight and remedial steps already taken to address the deficiencies identified in her practice. Therefore, the risk of repetition was nil.

Upon the deliberations of the panel, following my submissions, the Panel agreed with me in their findings that my client is not currently impaired hence there is no need for the third stage or sanction. The nurse was acquitted and permitted to continue her nursing profession.

This case was referred to the NMC in 2020, I am glad that after two years of agony, God has used me to put a smile on the nurse’s face. This is my first NMC victory in 2023 and I hope such victories continue for the rest of the year.
