What does Brexit mean for Employment Law?

2020 begins with the prospect of Brexit and substantial changes to Employment law. Some of these developments are already on the horizon.
What should I do to prepare for Brexit as an employer?

1. Carry out Brexit workforce checks

Now that the withdrawal agreement has passed the vote in the House of Commons and Brexit is due to go ahead on 31 January 2020. There is slightly uncertainty for European Economic Area (EEA) nationals and their employers. Following Brexit, there will be a transition period until 31 December 2020, during which EEA nationals will still be able to come and work in the UK.

2. Employers should ensure that all their EEA workers obtain settled or pre-settled status, to enable them to stay at the end of the transition period. The current position is that EEA nationals who are resident in the UK by 31 December 2020 have until 30 June 2021 to make an application.

Freedom of movement is likely to end on December 31 2020. UK citizens who wish to work in the EU are still able to apply for full-time employment, however, it is likely that these opportunities may be decreased during this period including freedom of movement of labour.
