People often talk about Probate as if it were a single application. In reality, administering an estate involves several stages.

1. Check whether Probate is needed
Not every estate requires a Grant. This can depend on the assets involved and how they were owned.

2. Establish who can deal with the estate
Where there is a Will, the executors named in it will usually be responsible. Where there is no Will, an eligible relative may be able to apply to administer the estate.

3. Identify and value the estate

4. Consider Inheritance Tax
Before applying for Probate, the estate needs to be valued and any relevant Inheritance Tax requirements considered.

5. Apply for the appropriate Grant
Depending on the circumstances, this may be a Grant of Probate or Letters of Administration.

6. Collect the assets
Once you have the necessary authority, you can gather and deal with the estate assets.

7. Settle liabilities Address outstanding debts, expenses, and relevant tax liabilities before distributing the estate.

8. Distribute the estate
The remaining estate can then be distributed according to the Will or, where there is no valid Will, the intestacy rules.

Every estate is different, and additional steps may be required depending on the assets and circumstances involved.

Where exactly does one property end and another begin?

The answer is not always as straightforward as looking at the red line on a Land Registry title plan. Most registered title plans show general boundaries rather than the exact legal boundary.

If a boundary is unclear or disputed, useful evidence may include:

• Title documents and historic deeds
• Transfer or conveyance plans
• Historic information about the properties
• Physical features such as walls, fences and hedges
• Evidence about how the land has previously been used
• A surveyor’s assessment, where appropriate

A fence or hedge alone should not automatically be assumed to mark the legal boundary.

Once the available evidence has been considered, the parties may be able to resolve the issue through discussion, negotiation or another form of dispute resolution. Where agreement cannot be reached, legal proceedings may sometimes be necessary to determine the position.

"What should you prepare before meeting a family solicitor?"

Preparing for your first meeting with a family solicitor does not mean arriving with every document you own.

A few key pieces of information can, however, help give a clearer picture of your circumstances from the start.

Depending on the issue, it may be useful to bring:

• A short timeline of the key events and dates
• Your marriage or civil partnership certificate, where relevant
• Details of any existing agreements or court orders
• Relevant correspondence between you and your former partner
• Information about your children and their current arrangements
• For financial matters, details of property, mortgages, income, savings, pensions and debts
• A list of the main questions or concerns you would like to discuss

Do not delay speaking to a solicitor simply because you do not have everything available.

Your solicitor can explain which documents will actually be needed once they understand your situation.

Estate planning can help you consider what should happen to your property, savings and other assets, as well as how you would like the people important to you to be provided for.

A few useful questions to consider are:

• Is your Will up to date?
• Have your circumstances changed since it was written?
• Have you bought or sold property?
• Has there been a marriage, separation, birth or other major change in your family?
• Do the arrangements you have in place still reflect your wishes?
