Is mediation required for divorce or separation?

If you cannot agree on a financial settlement or child custody—you are required to attend a Mediation Information and Assessment Meeting (MIAM). This meeting is often a necessary step before taking your case to court, and you will receive a MIAM certificate as proof of attendance.

Mediation is a collaborative, agreement-focused process designed to help you and the other party resolve disputes without resorting to costly and stressful court proceedings. Our approach emphasizes understanding each party’s perspective in a safe and respectful environment, ensuring that fairness is maintained throughout the discussion. We then create structured opportunities for both sides to work toward a mutually acceptable resolution.

Mediation is a process to assist parties to reach an agreement when they are in conflict. A person who is not directly involved in the conflict, called a mediator, is brought into a dispute. Unlike a judge in court, a mediator has no authority to impose any result on the parties. Instead, a mediator is impartial and has skills in communication and negotiation as well as knowledge about the conflict.

The mediator assists the parties to communicate; helps them understand each other's needs, values, and emotions; lays the groundwork to repair damaged relationships; and encourages creative options for resolution. Like a judge, however, the mediator should be impartial and have no allegiance to any of the individuals in the dispute.
