News | The High Court today hears the judicial review challenge against the Government’s decision not to publicly consult on major changes to Agricultural Property Relief (APR) and Business Property Relief (BPR).

Farmers, family businesses and advisers argue the Government broke its own Tax Consultation Framework, which requires public consultation on significant tax reforms. With these changes expected to have major effects across the agricultural and commercial sectors, stakeholders say proper consultation was essential. Many affected groups argue that bypassing the public consultation process set out in the Tax Consultation Framework has left businesses without the clarity and engagement required for such substantial tax reform.

James Austen, Partner at Collyer Bristow with conduct of the claim, says “The Government’s Tax Consultation Framework … was put in place because proper consultation is vital in getting tax changes right first time. Long experience shows tax consultations to be necessary for damaging unintended consequences – and embarrassing U-turns – to be avoided”.

The case will run until tomorrow afternoon at the Royal Courts of Justice, with judgment expected in writing within the next three months.

News | The High Court is currently hearing a major judicial review into the Government’s decision not to publicly consult on the proposed Agricultural/Business Property Relief changes — reforms with potentially significant consequences for farmers and family‑owned businesses.

Many affected groups argue that bypassing the public consultation process set out in the Tax Consultation Framework has left businesses without the clarity and engagement required for such substantial tax reform.

James Austen, Partner at Collyer Bristow with conduct of the claim, commented on the importance of the case and praised the collaborative effort between Collyer Bristow, Counsel Aparna Nathan KC, and the team at Alvarez & Marsal Tax.

The hearing continues until tomorrow, with judgment anticipated later this year.
