1. Step 1: Sending Your Application Once the pre-action letter fails, complete Form UTIAC1for Judicial Review, draft grounds, attached supporting documents, including, pre-action correspondence and refusal letter and and send it to:[email protected]
2. Step 2: Fees & Sealing the Application Pay the application fee of£174(as of April8,2025)(or apply for remission)After submitting, send a sealed copy of the application to the other party within9days.
3. Step 3: Acknowledgment of Service The other party must acknowledge receipt within21 days. A judge will decide if your case can proceed.
4. Step 4: Judge’s Decision on Permission The judge will decide whether to grant permission to proceed with your case. They may:✅Grant permission ❌Refuse permission ❓Not admit the application at all
5. Step 5: Paying the Fee to Continue If permission is granted, pay a further fee of£874within9 days of the judge’s decision .Failure to pay on time may result in your case being struck out.
6. Step 6: Substantive Judicial Review Hearing If the case proceeds, a judge will evaluate the merits of your claim.
7. Step 7: Judge’s Certification If the case is deemed without merit, you may need to apply for reconsideration with an additional fee of£438.
8. Step 8: Oral Permission Hearing The judge may allow an oral hearing. Follow all instructions to ensure your case progresses
