Legal misconception: “If we live together, we have the same rights as a married couple.”

There is actually no legal status of “common-law marriage” in England and Wales. Cohabiting couples do not automatically have the same legal protections as spouses or civil partners, no matter how long they have been together. This can affect matters such as property ownership, inheritance, pensions and financial arrangements if the relationship ends or one partner passes away.

Taking advice early and putting the right documents in place, such as a cohabitation agreement or a will, can help protect both parties.
