Amazon is alleged to have manipulated UK consumers by displaying more expensive offers in its “Buy Box” feature while hiding other more competitive offers. An economist estimates that UK consumers have overpaid by more than £1 billion since late 2015.

A collective claim has been filed with the Competition Appeal Tribunal to recover overpayments on behalf of UK consumers. We’re proud to be representing consumer rights champion Justin Gutmann who has today filed a claim against Apple in the Competition Appeal Tribunal on behalf of up to 25 million UK iPhone users.

Mr Gutmann alleges that Apple abused its market dominance by failing to make its customers aware of a power management tool they had concealed in certain iOS updates which throttled iPhones to disguise overloaded batteries. Our technical experts have estimated that this tool slowed affected devices by up to 58%.

£73M Claim Issued Against Govia Thameslink Railway

We have issued a new £73m Boundary Fares claim in the CAT against Govia Thameslink Railway Limited for Competition law breaches.

Mr Gutmann, a consumer champion, has launched this new claim against Govia Thameslink Railway (‘’GTR’’), which operates the Great Northern, Southern, Gatwick Express and Thameslink railways. Mr Gutmann alleges that GTR have failed to sufficiently inform their passengers of the existence and availability of ‘boundary fares’ tickets: this means passengers are paying twice for the part of their journey that is already covered by their TfL Travelcard. Mr Gutmann says this is a breach of UK competition rules.
The GTR claim has been issued in the Competition Appeals Tribunal, and will proceed to a certification hearing where the Tribunal will determine whether the CPO Application is suitable to be brought as collective proceedings and on an ‘’opt-out’’ basis on behalf of all persons who, at any point during the period between 24 November 2015 and the date of the final judgment or earlier settlement of the claims purchased or paid for, for themselves and/or another person, a rail fare which was not a Boundary Fare.
This is the third Boundary Fares claim that Mr Gutmann has issued on behalf of ticket holders against train companies. The first two claims against Southeastern and South Western have already been certified by the CAT and are proceeding to trial.

Our Landmark Case Has Been Certified – Moving To Trial

In exciting news for both our client, Mr Gutmann, and all train users, our boundary fares claim against the Southeastern and South Western franchises has been certified and will proceed to a full trial to assess liability and damages. The case has been brought against the companies for failing to make “boundary” fares readily available to Travelcard holders and failing to make passengers aware of their existence. This has resulted in millions of train users having to pay twice for the part of their journey covered by their Travelcard. The claims aim to put a stop to this double charging and are estimated to be worth around £93 million in damages to millions of passengers who have travelled in and around London.

The cases will now proceed to a full trial where we, and our co-counsel Hausfeld LLP, will argue for compensation for the millions of rail users who have been affected by the double charging.
