From 1 October 2026, the earliest release point for many standard determinate sentences moves to one-third of the custodial term — and it applies to people already in prison, not only to new sentences.
Before anyone gets their hopes up, read the exclusions.
Life sentences, EDS, SOPC and IPP sentences are not included. Neither is a long list of offences — manslaughter, death by dangerous driving, r**e and serious sexual offences, child sexual abuse and grooming among them.
And nobody is released all at once. It's being phased in across ten tranches between October 2026 and June 2027, based on sentence length.
One more thing worth knowing: the "earned credit" side of this hasn't been published yet. Anyone telling you exactly how days are gained or lost under the new scheme is guessing.
