The document was rejected.

The translation itself was accurate. The problem was that the type of translation did not match the overseas authority’s requirements.

A certified translation confirms the translator’s accuracy. A sworn translation carries formal legal status in countries that recognise sworn translators. They are not interchangeable.

The UK generally provides certified translations, not sworn translations. Depending on the destination, you may also need notarisation, an apostille or consular legalisation.

A witness can be in the room, and your will can still fail.

Under Section 9 of the Wills Act 1837, you must sign, or acknowledge your signature, in front of two witnesses who are present at the same time. They must then sign in front of you. Everyone needs a clear line of sight.

A video call does not count for new wills. Since 1 February 2024, both witnesses must be physically present. Even a witness distracted by serving a customer has caused a will to fail in court.

That assumption can put an inheritance at risk.

For a will signed in England and Wales, witnesses must be independent adults with mental capacity who can see you sign. Anyone who benefits from the will should not act as a witness, because their inheritance may fail.

Before signing, check that each witness:

✔️ Is aged 18 or over
✔️ Understands what they are signing
✔️ Is physically present and can see you sign
✔️ Will not receive a gift under the will
