🚨 Important Update for UK Employers: Right to Work Checks Expand from 1 October 2026

Under Section 48 of the Border Security, Asylum and Immigration Act 2025, right to work requirements are being extended beyond traditional employees to cover additional working arrangements.

Under the changes:

✅ Agency and temporary workers
✅ Casual and zero-hours workers
✅ Individual subcontractors
✅ Gig economy and platform workers

📌 What should employers do?

✅ Review all working arrangements, regardless of contract type
✅ Complete the required right to work checks before work begins
✅ Clarify checking responsibilities with agencies and labour providers
✅ Review contractor agreements and substitution arrangements

⚠️ Businesses that cannot establish a statutory excuse may face civil penalties of up to £60,000 per illegal worker.

These changes apply to relevant working arrangements starting on or after 1 October 2026 and affect businesses engaging labour in the UK, not just licensed sponsors.

🚨 IMPORTANT UPDATE: Skilled Worker Visa Jobs at Risk of Removal from January 2027

The UK immigration rules could be changing again, and employers, sponsored workers and prospective applicants should prepare for the upcoming changes to the Temporary Shortage List (TSL).

⚠️ What is changing?

The Migration Advisory Committee (MAC) has recommended reducing the number of occupations eligible for temporary Skilled Worker sponsorship from 52 to 28.

If the recommendations are adopted by the Government, some occupations may lose access to this temporary sponsorship route from January 2027.

✅ What does this mean for you?

🔹 Some medium-skilled occupations may no longer qualify for new Skilled Worker sponsorship under the temporary list.

🔹 Employers may need to review their recruitment and sponsorship plans.

🔹 Applicants considering jobs on the affected list should check their occupation code and eligibility before making decisions.

🔹 Existing Skilled Worker visa holders should seek advice before assuming that changes to the occupation list will affect their current permission or future extension.

📅 Important deadline: The current temporary arrangements are due to expire on 31 December 2026. The final impact will depend on the Government's decisions and the Immigration Rules in force at the relevant time.

⚠️ Please note: MAC recommendations are not automatically law. Not every occupation will necessarily be removed, and the position may differ for existing visa holders and new applicants.
