UK Visit visas are easy to refuse because there is no right of appeal. My clients are the mother and brother of a Colombian national. I had facilitated her application for a spouse visa to join her Polish (with EUSS Settled Status) husband in the UK. That was not straightforward because she had previously been refused entry to the UK to visit him because she gave all the "wrong" answers. We managed to secure the visa from Poland (where she is still waiting for her residency to be decided) and now they both wanted to bring her mother and her brother to tour Europe and then visit Scotland before going back to Bogota. Their UK visas were refused but their tickets were booked. I did a thorough review of the evidence which they should have supplied with their tourist visa applications, wrote an explanatory letter and the visas came through just in time for them to catch their flights. Innovator Founder Leave to Remain Application. This should have been straightforward because the Endorsing Body gave it the green light but the Home Office raised requisitions and I had to explain to the client how to deal with them. Her company is very new so she has not been obliged to file accounts but we arranged for management accounts. We then faced a further requisition and we supplied the evidence and then the Leave to Remain was granted. It is not only necessary to understand the legal position but it is also necessary to be able to explain it to the client AND to have an understanding of the business which the client is running and the business plan. Caseworker guidance states:
“You will not normally need to carry out a genuineness assessment for Innovator Founder applications. An endorsing body will already have assessed an applicant’s business plan and caseworkers are not expected to duplicate that assessment.
“A balance of probability test should only be carried out on an application if you have reason to believe that there are specific grounds to doubt a migrant’s genuineness. This power is primarily intended to be used where the Home Office has information that would not otherwise have been considered by an endorsing body when it has assessed a migrant’s suitability for endorsement.”
Here there was no specific reason given to me to doubt the genuiness of my client and her business. I am posting this because if you are faced with a Leave application you should be prepared to refresh what the Endorsing Body has stated in their report.

So many people seem to want to come to the UK to work although outside the caring industry the minimum salary level may defeat their ambitions. Two clients came to me who were prepared to pay a little over £38,700 to their Tier 2 employee and both the sponsor licence and the visa came through in a matter of days. In one case we had to beat the deadline of a student visa expiring but we beat it with a week to spare.

I am frequently approached by clients who have been living in the UK without status. Having met and married a "significant other" who is earning £29000 per year, they then go home and apply for a spouse visa. We always seek a priority decision (where this is available in your country) to try to keep the separation as short as possible. A well prepared bundle is so important and I ensure that the relationship evidence is presented to the highest possible standard.

A gay (male) Albanian client was refused asylum by the Home Office. Armed with well prepared witness statements and supporting evidence, an expert country report by Dr Enkeleida Tahiraj and the in court expertise of counsel, Claire Physsas, we won the appeal against the decision and the client now has his refugee status.

I am a sole practitioner so on more complex cases I work with Danny Bazini from No5 Chambers. Even after winning an appeal at 1st Tier against a refusal to grant EU Presettled Status to an Albanian client and even after winning the subsequent review brought by the Home Office in the Upper Tribunal, the Home Office still refused to grant EU status citing "further enquiries." In the end we filed a Judicial Review and the Home Office compromised it almost immediately after they received it and we have the EU status letter.

I haven't posted for a while. Since the beginning of the year a Tunisian client was granted asylum, we obtained a fiance visa within the 30 working day turnaround period, we settled the third in a series of Judicial Reviews with the Home Office, we successfully fought deprivation of British Citizenship appeals on behalf of two members of the same family and we are waiting for a hearing to review the unsuccessful appeals of two other members of the family. We have undertaken Sponsor Licence applications and Points Based visa applications and a review of a refusal to grant British citizenship.

I was not sure that I could switch a client from a Tier 5 International Agreement Visa to Tier 2 Skilled worker in Health and Social Care but her employers wanted her to work for them and the guidance showed that there was no reason why she could not switch from this category of Tier 5 into Tier 2. Within 2 weeks we have a positive decision, a deliriously happy client and happy employers.
