Before you can trade mark a business name, you need to check if it’s available. You can do this by searching the trade mark databases, if they’re available in your country.

For businesses in United Kingdom, you can search the trade mark database on the IP UK government website: https://www.gov.uk/search-for-trademark.

If you’re not sure how to search the trade mark database, our team at Pulse Law can help.

But keep in mind, this search is only useful if you want to see if there is an identical or near identical mark. This search may not help you to identify similar marks that may still prevent your mark from being registered.

Remember a "mug" and a "cup" can be used interchangeably, but they don't look or sound the same.

A frequent misconception is that trademarks, copyrights, and patents all protect the same things.

However, there are significant differences between these three types of intellectual property.

Generally speaking, trademarks protect your company's name and logo. Copyrights protect your original works of authorship, including books, music, and artwork (but they can also protect a brand). Patents protect your inventions and ideas.

So, if you want to protect your brand, registering a trade mark is usually the best way to do so.

And if you have any original works of authorship or inventions, be sure to copyright or patent them accordingly.

Speak with one of our attorneys to learn what you need to do to protect your business.

Are you confused about the difference between a company name and a trade mark?

If so, you're not alone! Many people think that owning a company name gives them same rights as owning a trade mark, such as exclusivity in the company name.

This is not the case!

A company name could be your trading name and/or your business name.

A trade mark is a distinctive sign used to identify your products or services from others. This could be your company name or trading name, but it could also be your logo or any other distinctive sign that points to the goods or services coming from you.

It's important to understand the difference between the rights obtained from these two terms, because it could impact your ability to protect your business.

What Are the Benefits of Registering Your Trademark?

✅ Protecting your brand will aid in establishing a reputation, as your customers will be able to recognise and trust your brand.

✅ You can prevent competitors from using a similar or identical trade mark and ensure that nobody benefits from your goodwill.

✅ A registered trademark works as an asset with monetary value that may be sold to a potential buyer in the event of selling your business.

✅ By including the ® mark in your logo, you can show your customers that your brand is legally protected and that your business can be trusted.

✅ A registered trade mark allows you to assert your legal rights against other parties and can be far stronger than unregistered rights such as passing off and copyright.

®️ Do you own your logo or any of your brand assets?

If not, you may run into the following risks:
👉 The creator could sell your logo to another company, causing you future complications.
👉 You may be challenged that you are not the sole owner of the mark, or others may use an identical mark in the course of trade, which could cause confusion.

So, how do you avoid these risks?

Determine whether your content or branding was generated by a third party, then take all necessary steps to ensure you own them, which should include a written agreement transferring the ownership of those brand assets to you.

So, let's imagine you hire a graphic designer and a website designer to create your company logo and website content.

Would this mean that you own the logo and any of the website assets?

Legally speaking, you may not own the logo or website content.

The only sure way to protect your brand's assets is to get a written agreement that transfers the work to you so that you own it and can then exploit it.
