Someone owes your business money. But will there be anything left to recover?

If you’re worried they’re moving money, selling property or hiding assets to avoid paying you, it’s time to seek professional advice.

A freezing order is a court order that can stop someone from moving or disposing of assets while your legal claim is dealt with. It won’t recover the money on its own, but it may help keep assets available if your claim succeeds.

Our team can explain whether this is an option for you, what evidence you’ll need and the steps involved.

Concerned that assets could disappear? Contact our team today to discuss how you can protect your position:

Shareholder disputes rarely begin in the courtroom.

Exclusion from management, disagreements over control, concerns about company funds or a breakdown in trust can quickly develop into an unfair prejudice claim under Section 994 of the Companies Act 2006.

Whether you are considering bringing a claim or defending one, early advice can be critical to protecting your position, the value of the business and the options available to you.

Our latest article by Ian Coupland, Head of Litigation explains:

• When an unfair prejudice claim may arise

• The remedies available, including potential share buyouts

• How claims can be defended

• Why strategy and timing matter in shareholder disputes

Locked out of your business premises. What happens next?

Following a landlord’s disputed forfeiture of a commercial lease, our client needed urgent help to regain access and protect its operations.

Ian Coupland and Paige Evans secured an interim injunction in the High Court. The landlord was ordered to restore our client’s access to the premises forthwith.

A key issue was whether the landlord’s subsequent rent demands were inconsistent with treating the lease as ended. The Court found our client had a sufficiently arguable case on that point and that damages would not be an adequate remedy at this stage.

For businesses facing exclusion from their premises, timing and clear evidence can be critical. Read how our litigation team approached the application: https://www.adambenedict.co.uk/news/commercial-tenant-high-court-injunction-forfeiture

“From the outset I was given tasks and treated like a member of the team.”

What does a week of work experience at Adam Benedict look like? For law student Benjamin Thomson, it meant drafting hearsay notices, researching corporate and employment matters, working on client communications and exploring a personal interest in sports law.

Their account offers an honest look at the step from studying legal principles to applying them to real matters, with guidance from the team along the way.

When a construction dispute has dragged on for months, clear advice and a way forward can make all the difference.

See the glowing review for Grace Jenkins’ recent work:

“We spent a long time trying (and failing) to amicably resolve an underfloor heating dispute with a medium-sized renewable energy company, before finally deciding to take the plunge and instruct a solicitor. We initially had some reservations about using a smaller and more specialised law firm, but we’re now so glad that we did.

Grace Jenkins from Adam Benedict couldn’t have done a better job for us - her direct manner was a welcome relief after the preceding months of pointless waffle from the other side, and her knowledge of both construction law and dispute resolution proved invaluable. It was very easy to contact her when we needed to, and we had total confidence in her leading all of our discussions during pre-action meetings. Despite every contact with the other side leaving us with less and less hope at each stage, Grace was able to skilfully negotiate a substantial settlement as well as payment of our legal costs without the need for a hefty court battle.

We would highly recommend Grace and Adam Benedict to anyone in a similar situation who’s looking for a steady guiding hand to see them through. Thanks so much Grace!”

Thank you for trusting Grace with your dispute and for taking the time to share your experience.
